20/20 Eye Care Network, Hearing Care Network data breach $3M class action settlement

iCare Acquisition agreed to a $3 million class action lawsuit settlement to resolve claims a data breach compromised 20/20 Eye Care Network and 20/20 Hearing Care Network patient data.

The settlement benefits individuals who received a data breach notification from 20/20 Eye Care Network or 20/20 Hearing Care Network as a result of the data breach that occurred in January 2021.

20/20 Eye Care Network and 20/20 Hearing Care Network allegedly experienced a data breach in January 2021 which compromised sensitive patient information. According to plaintiffs in the data breach class action lawsuit accused iCare Acquisitions of failing to protect their information from the breach. 

20/20 Eye Care Network and 20/20 Hearing Care Network are health plan networks that provide vision- and hearing-care coverage. The two networks are part of iCare Acquisition. 

iCare Acquisition hasn’t admitted any wrongdoing but agreed to a $3 million class action settlement to resolve these allegations.

Under the terms of the settlement, class members can receive reimbursement of up to $2,500 for data breach damages. This includes out-of-pocket expenses, such as credit monitoring purchases and credit report costs, as well as up to 10 hours of lost time at a rate of $25 per hour. 

Class members who experienced actual identity theft as a result of the data breach can receive compensation of up to $5,000. 

All class members are eligible for three years of identity monitoring protection services. In lieu of these services, class members can opt to receive a $50 cash payment. The amount of the cash payments may be reduced based on the number of claims filed. 

The deadline for exclusion and objection is April 3, 2023.

The final approval hearing for the settlement is scheduled for June 22, 2023.

To receive settlement benefits, class members must submit a valid claim form by May 1, 2023.
