LendUS LLC agreed to a class action lawsuit settlement to resolve claims it failed to protect consumers from a 2021 data breach.

The settlement benefits individuals who received a data breach notice from LendUS LLC regarding a cyberattack that occurred between Feb. 2 and March 22, 2021.

The settlement also covers a California subclass of the same consumers who lived in California when they received their data breach notice.

From February to March 2021, LendUS was reportedly the victim of a cyberattack that compromised consumer information including Social Security numbers. Affected consumers took legal action against the company, arguing that LendUS could have prevented the breach through reasonable cybersecurity measures.

LendUS is a California-based mortgage lender. CrossCountry Mortgage acquired the company In April 2022.

LendUS hasn’t admitted any wrongdoing but agreed to pay an undisclosed amount as part of a settlement to resolve the data breach class action lawsuit.

Under the terms of the LendUS lawsuit settlement, class members can receive up to $500 in reimbursement for documented data breach losses including bank fees, communication charges, credit report costs and more. Class members must provide documentation of these losses in order to receive compensation.

Class members can also receive payments for up to three hours of lost time at a rate of $20 per hour, subject to the $500 ordinary expense reimbursement cap. Lost-time payments may be increased on a pro rata basis if total loss time claims do not exceed the $7,420 minimum listed in the settlement terms.

California subclass members can receive an additional cash payment of $100, subject to the $500 cap for ordinary expense reimbursement. As with lost-time payments, these subclass payments may be increased on a pro rata basis if California subclass claims do not exceed the $10,744 minimum listed in the settlement term.

Consumers who experienced unreimbursed extraordinary losses including fraud and identity theft can collect higher payments of up to $2,500. As with the ordinary loss reimbursement, class members must provide documentation of extraordinary losses.

All class members are eligible to receive three years of free identity theft protection via Pango’s Financial Shield. This service includes up to $1 million in identity theft and fraud insurance, transaction monitoring, credit-report monitoring, dark-web monitoring, credit-freeze assistance, lost-wallet protection and more.

The deadline for exclusion and objection is March 20, 2023.

The final approval hearing is scheduled for June 30, 2023.

To receive settlement benefits, class members must submit a valid claim form by April 19, 2023.
