UMass Memorial Health Center (UMMHC) agreed to a $1.2 million class action settlement to resolve claims it failed to protect consumers from a data breach.
The settlement benefits consumers whose personal information was compromised in the UMass data breach between June 24, 2020, and Jan. 7, 2021, and who received a notification regarding the data breach.
Plaintiffs in the class action lawsuit accuse UMass Memorial Health of failing to safeguard their sensitive data from a data breach in 2020 and 2021. The breach allegedly harmed nearly 3,000 Massachusetts residents when their names, driver’s license, financial accounts, Social Security numbers and other data was exposed.
The UMass Memorial Health data breach occurred between June 24, 2020, and Jan. 7, 2021. UMass informed consumers of the breach in October 2021.
UMass hasn’t admitted any wrongdoing but agreed to a $1.2 million class action settlement to resolve these claims.
Under the terms of the UMMHC settlement, class members can receive ordinary expense reimbursement of $150 for bank fees, communication charges and three hours of lost time at a rate of $25 per hour.Â
Class members can also receive up to $5,000 for extraordinary expenses, including documented, unreimbursed fraud and identity theft. The settlement also provides two years of credit monitoring services through IDX Identity Protection Services.
In lieu of the benefits listed above, class members may select to receive a $40 payment. Payments may be prorated to a lower or higher sum based on the number of claims filed for this relief.Â
The deadline for objection is March 15, 2023. There is no exclusion opportunity for this settlement.
The final approval hearing for the settlement is scheduled for May 23, 2023.
In order to receive settlement benefits, class members must submit a valid claim form by April 14, 2023.
