Bombas Settlement Update:

Certain consumers who purchased Bombas socks or other items on the Bombas website may be able to benefit from a $225,000 settlement with the company and ecommerce platform Shopify resolving claims their information may have been compromised during a Bombas data breach.
The Class is made up of all individuals residing in the United States who purchased Bombas socks or other merchandise on Bombas’ website from Nov. 11, 2016, through Feb. 16, 2017.
Plaintiffs in a class action lawsuit allege their payment card information and other data was potentially exposed during the Bombas data breach. They claim the company and Shopify were responsible for the breach and accused it of negligence, violating California laws, and invasion of privacy.
Bombas socks, shirts, and other garments are sold on the retailer’s website. The company denies all allegations of wrongdoing.
The Court has not ruled in favor of either party in this case.
Class Members who submit claims and the required documentation may be eligible for one of two types of payments: a basic award or a reimbursement award.
Each Class Member is eligible to receive a basic award of $50, regardless of whether they experienced any unauthorized charges on their card. Anyone filing a claim for a basic award must provide the documentation required on the claim form.
Alternatively, Class Members may seek a reimbursement award of up to $2,500 if, at any time between Nov. 11, 2016, and Feb. 16, 2017, they experienced unauthorized charges on their debit or credit card that were not denied or reimbursed and that the Class Member believes in good faith were likely caused by the Bombas data breach.
The following types of expenses are eligible to be covered by a reimbursement award:
- Those unreimbursed and unauthorized charges
- Up to three hours of lost time spent dealing with unauthorized charges or the Bombas data breach at a rate of $20 per hour
- Out-of-pocket expenses arising from or related to the Bombas data breach, such as payment card fees or bank fees, such as card re-issuance fees, overdraft fees, charges related to unavailability of funds, late fees, over-limit fees, and fees related to an account being frozen or otherwise unavailable; cellphone, internet, or text charges; preventive costs or charges, such as the purchase of credit monitoring, placing security or credit freezes, and obtaining credit reports or credit freezes; and postage costs
No other types of expenses will be reimbursed. Class Members are not entitled to recover any award for emotional distress.
In addition, Class Members must exhaust all available credit-monitoring insurance and identity-theft insurance before filing a claim for a reimbursement award. These claims also must be accompanied by the documents required on the claim form.
Class Members’ payments may be adjusted up or down depending on how many people submit valid claims.
A fairness hearing is scheduled for Nov. 19, 2021.
Requests to be excluded and written objections to the Bombas settlement must be received by Oct. 12, 2021.
Claims must be submitted online or postmarked by Nov. 9, 2021.

Proof of Purchase
A receipt, bank or credit card statement, or other proof of purchase showing your purchase from the Bombas website.
You may file a claim without proof of purchase by attesting under penalty of perjury that you made a purchase on the Bombas website and provide the date and last four digits of the card used.
You may also file a claim by attesting under penalty of perjury that you no longer have the card that was used and do not know or have any records that show the last four digits of the card.
