Individuals whose medical and other personal information may have been compromised in a December 2019 data breach at Overlake Hospital in Bellevue, Washington, may be eligible to benefit from a class action lawsuit settlement.
The Class includes anyone whose private information was received, gathered, shared, obtained, or otherwise found itself in the possession of the defendants and potentially affected by the data breach.Â
Those who previously received a notification from Overlake Hospital about the data breach may be a Class Member; however, not all individuals who received such a notification are a part of the Class because investigations that took place after the notifications were sent showed only about 24,000 of the roughly 109,000 individuals notified actually had their data potentially affected.
The plaintiff in an Overlake Hospital class action lawsuit alleged Class Members’ personal information, such names, health insurance information, birth dates, medical information, and other data protected under the Health Insurance Portability and Accountability Act of 1996 (HIPAA), was compromised during the cyberattack. The plaintiff accused Overlake Hospital of failing to safeguard the information and failing to provide adequate notice about the data breach.
Overlake Hospital is a 349-bed facility in the Seattle area. The medical center provides services ranging from cancer treatment and dermatology to behavioral health, emergency care, and more.
Overlake Hospital Class Action Lawsuit Settlement Benefits
The settlement provides for two types of payments to Class Members.
Class Members filing claims for Expense Reimbursement are eligible for a reimbursement of up to $250 for certain categories out-of-pocket expenses resulting from the data breach:
- Bank fees, long-distance phone charges, cellphone charges (if charged by the minute), data charges (if charged based on the amount of data used), postage, or fuel for local travel
- Fees for credit reports, credit monitoring, or other identity-theft insurance products purchased between Feb. 4, 2020, and the date of the Court’s preliminary approval of the settlement; for these claims, the Class Member must make an affirmative statement that the product was purchased primarily because of the Overlake Hospital data breach
- Reimbursement for up to three hours of documented time lost to dealing with the data breach, such as time spent reversing fraudulent charges or rescheduling medical appointments, at $20 per hour if at least one full hour was spent and if the time is able to be documented with reasonable specificity by answering the questions on the claim form.
Class Members may file Extraordinary Expense Reimbursement claims for up to $2,500 in unreimbursed monetary losses they suffered due to having their information compromised as part of the data breach.
To make this type of claim, the Class Member must demonstrate the loss is an actual, documented, and unreimbursed monetary loss that was more likely than not caused by the data breach and occurred between Dec. 1, 2019, and the end of the applicable claims period.
The loss must not be covered by one or more of the other categories, and reasonable efforts must have been made to avoid or seek reimbursement for the loss, including exhausting all available credit-monitoring and identity-theft insurance.
In addition, Overlake Hospital has spent at least $148,590 to improve information security enhancements since the data breach and will commit to continuing enhancements at an estimated cost of $168,000 annually in 2021, 2022, and 2023.
A fairness hearing in the Overlake Hospital data breach lawsuit settlement will be held Sept. 10, 2021.
Those who wish to opt out of or object to the settlement must do so by Aug. 13, 2021.
The deadline to file a claim is Dec. 13, 2021.

Ordinary Expenses Resulting from the Data Incident: copy of a statement from the company that charged you, or a receipt for the amount you incurred, a copy of a receipt or other proof of purchase for each credit report or product purchased.

Extraordinary Expenses: Attach a copy of statements that demonstrate that identity theft or fraud occurred and any correspondence showing that you reported the fraud, receipts, police reports, or other documentation supporting your claim.
