Apple AirTag stalking class action lawsuit overview:
- Who: Lauren Hughes and Jane Doe filed a class action lawsuit against Apple Inc.
- Why: Hughes and Doe claim Apple ignored advocates by releasing AirTag devices to the public that they argue have been used by stalkers and abusers to track victims.
- Where: The class action lawsuit was filed in California federal court.
Apple puts the safety of consumers at risk with its AirTag tracking device, which has become the “weapon of choice” for abusers and stalkers, a new class action lawsuit alleges.
Plaintiffs Lauren Hughes and Jane Doe claim Apple ignored pushback from advocates and technologists who urged it to rethink releasing its AirTag product and consider its “inevitable use in stalking.”
Apple, instead of listening to advocates, “heedlessly forged ahead, dismissing concerns and pointing to mitigation features that it claimed rendered the devices ‘stalker proof,’” the Apple class action states.
The concerns turned out to be “well founded,” according to Hughes and Doe, who claim there were immediate reports of stalkers using the devices to track the whereabouts of their victims after the AirTag’s release.
“The consequences have been as severe as possible: at least two reported murders have occurred in which the murderer used an AirTag to track the victim,” the Apple class action states.
Apple class action alleges AirTag devices allow tracking without consent
Hughes and Doe want to represent classes of iOS and Android device owners, along with multistate and NewYork subclasses of consumers, who were tracked with an Apple AirTag without consent.
They accuse Apple of unjust enrichment, negligence, negligence per se, intrusion upon seclusion and violations of New York General Business Law and California’s Constitutional Right to Privacy, among other things.
Hughes and Doe demand a jury trial and request injunctive and declaratory relief along with an award of actual, nominal, statutory and/or punitive damages for themselves and all class members.
In other Apple privacy news, a consumer filed a separate class action lawsuit was filed against Apple last month, arguing the company illegally records the confidential activity of its mobile app users for profit.

49 thoughts onApple class action claims AirTag can be maliciously used to stalk victims
I just found an apple airtag device in my trunk last night. After my “Stalker gave me an address that I had been to earlier that night.” There’s no way he could have known. I downloaded an app and ran my phone around my car. I would have never thought I would find one. I am extremely unhappy with Apple bringing thus product to life. There are way too many bad individuals that will and do take advantage of this airtag. I get threatening text messages and stalked and harrased daily. I don’t go anywhere not looking over my shoulder.
It’s definitely scary I was tracked in dangerous fashions to please add me
Just so everybody is aware you can do that with the air buds too and there should be something on your phone that lets you know you’re being tracked I’m not making excuses for anybody I’m just telling you how to protect yourself and what to watch for
I recently found an AirTag hidden in the panel of my passenger side seat my IPhone send me the alert of the AirTag tracking me after 12 hours later of being tracked I have the AirTag but I don’t know placed it there and there’s no way for me to find out who put it there
You can scan the tag it will tell Apple who it is every person who orders one it’s a signed a number too
Thanks!
My case is sensitive and involves domestic violence. In addition to stalking me via Fasttrack/Smart tag, vehicle OnStar and Apple Air Tag, recent Apple device that was confirmed by Apple to belong to my ex husband has been found, it was being used to aggressively stalk and harass me and my son, whom I have a court order for. I have reached out to Apple and nothing has been done about it. I live my life in constant fear and feel that my voice no longer matters. I wish to be added to this class action lawsuit or I would not mind pursuing my own action being that I have TWO individual Apple devices that were illegally used to stalk, track and Harass me within a 7 month time period. I am a single, sole earning mother with a child and living in fear is not a way to live.
My ex boyfriend put an airtag in my car months before I found it. He refused to move out for months claiming he was “looking for a place” mean while having access to my things.. which made it that much easier for him to place the airtag in my trunk. He was stalking me for months and following me everywhere. Until one day I caught him outside a restaurant looking for me. That confirmed my suspicion. I threatened to go to the police if he didn’t remove the airtag, police station didn’t to anything! I have an android which is why I never found it all those months.. until my brother’s iPhone picked it up. Found the airtag, took it to the police station that it was proof he was tracking and stalking me. Again, the police did NOTHING!
dealership found one on my car, then a lil while later my friend who i let borrow my car, found one up under the car and flushed it.
