A $3.2 million settlement has been reached, ending claims that a Washington State University security incident led to the disclosure of the private information of 1 million individuals.
Class Members include those whose personal information, financial information, or educational records were on a hard drive that was stolen in April 2017 from Washington State University’s Social & Economic Sciences Research Center.
Lead plaintiffs alleged in their WSU class action lawsuit that the institution failed to properly protect their and approximately 1 million other individuals’ personal information.
The WSU security incident class action lawsuit claimed that the institution failed to secure data that it had collected regarding peoples’ health, finances, and education.
According to the WSU class action, the stolen hard drive contained names, Social Security numbers, educational, and personal health information.
Further, WSU reportedly failed to properly notify those affected by the security incident. The plaintiffs alleged that they and others were not informed of the details of their stolen personal information.
The institution agreed to settle the WSU security incident class action lawsuit. Under the terms of the settlement, Class Members can claim credit monitoring and insurance services, as well as reimbursement for out-of-pocket costs and lost time. WSU has also agreed to update and improve its security policies and procedures.
Class Members can claim credit monitoring and insurance services provided by Identity Guard worth $19.99 a month. Further, Class Members who suffered from fraud or identity theft will be eligible to receive up to $1 million in reimbursement insurance from AIG to cover any losses.
Class Members can also claim out-of-pocket costs, including credit card fees, returned check fees, card cancellation costs, the purchase of credit reports, and money spent on credit monitoring and protection.
To make a claim for out-of-pocket costs, Class Members must be able to provide documentation. Claims are limited to $5,000.
Class Members can further claim reimbursement for time they spent dealing with identity theft or fraud they were exposed to due to the WSU security incident. Class Members can claim $15 per hour for up to three hours of their time.
Class Members must submit a Claim Form either online or by mail.
The deadline for Class Members to exclude themselves or opt out of the WSU security incident class action settlement is Aug. 19, 2019.
Who’s Eligible
Class Members include “all individuals whose personal information (including but not limited to social security numbers), financial information, and/or educational records were on the WSU Social & Economic Sciences Research Center’s hard drive stolen in April 2017 from Quality Self Storage in Olympia, Washington.”
Potential Award
Up to $5,045 and Credit Monitoring.

- Cash payment for reimbursement of documented out-of-pocket costs, up to $5,000
- Cash payment for lost time, up to $45
Proof of Purchase
Online Claim Forms require a Unique ID. Out-of-pocket costs require reasonable documentation, including receipts or bank statements.
