Zoloft Birth Defect Class Action Lawsuit Moved from Federal to State Court

The Zoloft birth defect class action lawsuit, which was moved to federal court at the request of Pfizer, was pushed back into federal court this week. The Zoloft class action lawsuit alleges that Zoloft (sertraline HCI) caused birth defects in 21 children whose mothers were prescribed Zoloft while pregnant.
Zoloft is in a class of drugs called serotonin reuptake inhibitors or SSRIs. The Zoloft class action lawsuit alleges that Pfizer knew, or should have known, that mothers who had taken SSRI drugs like Zoloft are at a greater risk of having a baby born with congenital birth defects like Persistent Pulmonary Hypertension (PPHN,) Atrial Septal Defects (ASD,) ventricular septal defects (VSD,) abdominal birth defects (omphalocele,) cranial birth defects (craniosynotosis,) aorta coarctation, hypoplastic right or left heart syndrome, transposition of the great arteries (TGA), tetralogy of fallot (TOF), spina bifida or other birth defects.
The Zoloft birth defect class action lawsuit also alleges that Pfizer didn’t adequately warn the medical community and the public of the danger that Zoloft could have for pregnant mothers and their unborn children. The Zoloft birth defect lawsuit accuses Pfizer of negligence, negligence of pharmacovigilance (which requires Pfizer to monitor safety issues for its drugs,) failure to warn, and fraud. The Pfizer Zoloft class action lawsuit seeks both actual (medical and care expenses) and punitive damages.
