Yaz Pulmonary Embolism Lawsuit Filed Against Bayer

Yaz pulmonary embolism lawsuitA New Mexico woman has filed a Yaz pulmonary embolism lawsuit against Bayer accusing the drug maker of developing and marketing a product that the company knew was unsafe. Her Yaz lawsuit is seeking compensation for the medical expenses she incurred for treating her pulmonary embolism, which she claims could have been avoided if Bayer had adequately warned her and other women about the series side effects of Yaz and Yasmin.
 
Stephanie Brazil alleges in the Yaz pulmonary embolism lawsuit, filed on May 29, 2012 in the U.S. District Court, Southern District of Illinois, that she took Yaz birth control from 2005 until 2009. Stephanie says she stopped taking the controversial oral contraceptive after she developed a pulmonary embolism, which is caused by blood clots getting into the lungs. Yaz pulmonary embolism is a common side effect among Yaz and Yasmin users. Other common Yaz side effects cited in lawsuits are Yaz blood clots, heart attacks, strokes and deep vein thrombosis. Last year, the U.S. Food and Drug Administration (FDA) warned that women taking Yasmin or Yaz are 74% more likely to suffer blood clots than women on other low-estrogen contraceptives.

 
Yaz/Yasmin side effects are potentially deadly, which is why thousands of women across the country have filed lawsuits against Bayer for failing to properly warn consumers and healthcare professionals about the dangers linked to Yaz and Yasmin. Yaz lawyers suing the drug maker cited FDA reports of at least 50 deaths tied to the pills from 2004 to 2008.
 
Some Yaz/Yasmin lawsuits are citing Bayer’s original marketing campaign, which primarily focused on the pills’ ability to cure acne and severe PMS — uses not approved by the FDA. The agency eventually forced Bayer to correct those ads and include serious warnings on the labels. This new warning was too little too late for many women, however, who were already suffering from Yaz/Yasmin side effects. Thousands of women have chosen to sue Bayer for continuing to market Yasmin and Yaz as “just as safe” as other birth control products, when the company knew the increased risks of Yaz blood clots, pulmonary embolism, and other dangerous side effects. Their Yaz lawsuits are alleging fraud, breach of express and implied warranties, and other violations. Some Yaz lawsuits are also seeking compensation for spouses for loss of consortium, claiming they lost the company and “society” of their wives as a result of the Yaz injuries they suffered. Others are seeking compensation though Yaz wrongful death lawsuits filed by family members of women who have died from Yaz side effects. 
 
Many of these cases have been consolidated in the ongoing and growing Yaz/Yasmin multi district litigation case currently pending in the U.S. District Court for Southern Illinois, entitled Yasmin and Yaz (Drospirenone) Marketing, Sales Practices and Products Liability Litigation.
 
 
Yasmin/Yaz Lawsuit MDL
 
The Yasmin/Yaz lawsuit MDL allows thousands of Yasmin and Yaz users to file lawsuits under the jurisdiction of one judge, retain their own attorney, and receive an individual award if the case is won or settled. If an MDL settlement is reached, the award they would receive is typically much larger than any individual award expected in a Yasmin/Yaz class action lawsuit.
