Parents File Zoloft Birth Defect Lawsuit Over Son’s Head & Heart Defects
By Andrea Gressman
On September 17, 2012, a new Zoloft birth defect lawsuit was filed by a Wisconsin couple. They claim in their Zoloft lawsuit that their son developed severe birth defects after the baby’s mother used Zoloft during her pregnancy. The Zoloft birth defect lawsuit has joined the current Zoloft lawsuit multidistrict litigation (MDL) located in the Eastern District of Pennsylvania. It names Pfizer as the defendant.
The plaintiffs in the Zoloft birth defect lawsuit claim that the mother used Zoloft according to her physician’s instructions during her pregnancy. They go on to claim that if the information provided with the medication had properly warned her of the possible side effect risk of their child developing birth defects she would have never taken the medication in the first place.
Rare Heart Defect Associated with Zoloft Pregnancy Use – Tetralogy of Fallot
The Zoloft birth defect lawsuit states that the affected child was born on May 14, 2011. It goes on to describe that the baby experienced life-threatening side effects due to the SSRI antidepressant, specifically heart defects. They claim in the Zoloft birth defect lawsuit that these side effects were directly caused by the mother taking Zoloft during her pregnancy with the child.
Sagittal craniosynostosis was one of the specific birth defects listed in the Zoloft lawsuit. This is a condition in which the separation of the parietal bones that formed the baby’s skull closed too early, which of course would affect the child as the brain continues to grow. There was another side effect mention in the Zoloft lawsuit – Tetralogy of Fallot. This is a congenital heart defect that is rare in nature. It is also very complex and involves four different heart malformations. These include the following:
- A hole in the septum between the two lower chambers of the heart
- A narrowing of the pulmonary valve
- An overriding aorta;
- A thick right ventricle
- Breach of warranties
- Constructive fraud
- Design defect
- Fraud
- Gross negligence
- Negligence Negligent design
Studies Show Link Between Zoloft and Heart Defect Side Effects
The Zoloft lawsuit claims that Pfizer did not properly warn of the potential dangers that have been linked to the use of Zoloft during pregnancy. The Zoloft birth defect lawsuit also accuses Pfizer, the manufacturer of Zoloft, of not reviewing their medical literature on a periodic basis to ensure that it is accurate and properly pertains to the medication. They go on to charge that Pfizer failed to report certain data that was critical to establishing Zoloft’s safety, or in this case, the lack thereof.
In 2006, a study was published in the New England Journal of Medicine that showed a relationship between SSRI antidepressants, like Zoloft, and the side effect risk of infants developing persistent pulmonary hypertension of the newborn (PPHN). Another study was published in 2007 in the Journal indicated that mothers that took Zoloft during their pregnancy were at much higher risk for having a baby that had a heart defect.
