NuvaRing Lawsuit Trial Dates Could Encourage Early Settlements

NuvaRing was marketed as a birth control option with fewer side effects than other birth control choices. However, with the number of NuvaRing lawsuits being continually filed, NuvaRing’s claim of fewer side effects does not seem to be all together accurate.
With the NuvaRing lawsuits progressing through the litigation process, the judge overseeing the NuvaRing lawsuit MDL recently set the first set of trial dates for the spring of 2013. However, this new progression in the NuvaRing lawsuit MDL could actually mean that there will be early NuvaRing lawsuit settlements in order to avoid the possibility of a trial.
The lawsuits in the NuvaRing MDL are typically based on specific NuvaRing side effects. NuvaRing is marketed as an innovative monthly birth control ring designed for vaginal use, with effects reminiscent of the pill or patch variations of contraception in that it prevents pregnancy, but more conveniently than the competition. Along with other things, the warning inserted within the NuvaRing package indicates that the vaginal ring implant and the pill have similar side effect risks associated with them. According to many NuvaRing lawsuits, however, NuvaRing studies were not the basis for the information given on safety of the device, therefore making the information in NuvaRing’s package insert deceptive.
Hundreds of similar NuvaRing lawsuits have been filed by numerous young women blaming NuvaRing for severe, potentially fatal injuries, which include deep vein thrombosis, pulmonary embolism, blood clots, heart attack and stroke. Most of these NuvaRing lawsuits were filed in a federal MDL with Judge Rodney W. Sippel of Missouri’s Eastern District, U.S. District Court presiding. There are more NuvaRing lawsuit claims pending in a Mass Tort proceeding in New Jersey’s Superior Court in Bergen County.
Research conducted over the past year has proven that NuvaRing use can enhance the side effect risk of serious blood clots. Severe adverse side effects such as pulmonary embolism may result from such blood clots, which are less likely with the competition, such as birth control pills.
A 2011 study published by the FDA revealed that NuvaRing increased the risk associated with blood clots, which include pulmonary embolism and deep vein thrombosis by 56% compared to older contraceptives in pill form. The New England Journal of Medicine and the British Medical Journal published two additional studies over the summer indicating that those who use NuvaRing potentially had an increased risk of experiencing severe blood clots, not to mention strokes and heart attacks.
