New Yaz Stroke Lawsuit Filed by Calif. Woman

Yaz Yasmin lawsuitAndrea McDade became one of the latest plaintiffs in the string of birth control lawsuits being filed against the manufacturers of several different birth control options, including Yaz, Yasmin, Ocella, and Beyaz. She filed her Yaz/Yasmin lawsuit on October 19, 2012 in the Superior Court of the State of California, Los Angeles. Bayer, the manufacturer of Yaz, Yasmin and Ocella, was named as the defendant. The Yaz/Yasmin lawsuit has joined the coordinated proceedings currently being held in the California Superior Court.

Bayer Accused of Negligence and Failure to Warn in Yaz/Yasmin Lawsuit

The plaintiff reported in her Yaz/Yasmin lawsuit that she suffered from a stroke on March 27, 2011 due to blood clots she developed after using the oral birth control Yaz or Yasmin. Ms. McDade was only 33 year of age when she had her stroke. The plaintiff charges the birth control manufacturer with the following:

  • Negligence
  • Failure to warn
  • Negligent misrepresentation
  • Manufacturing defect
  • Deceit by concealment
  • Breach of warranties
  • Violation of business & professions code 17200
  • Fraud and fraudulent concealment


Ms. McDade is seeking to receive compensation from Bayer for both past and future medical expenses. She is also seeking compensation for past and future emotional and mental distress as well as loss of earnings, in addition to her future earning capacity and legal expenses.

FDA Issued Warning Against Yaz /Yasmin/Ocella Side Effects

The main issue when it comes to Yaz, Yasmin and Ocella is that they all contain drospirenone. This is a synthetic progestin and has unfortunately been associated with causing the development of blood clots. The FDA finally commissioned a study, which included 835,000 women. The study found that the women who used birth control options containing drospirenone had two times the side effect risk of developing blood clots in comparison to those who used other birth control options. There have been other studies have determined the side effect risk to be as high as 3-fold. The FDA issued a warning on April 2012 and required that a stronger warning about the side effect risk associated with blood clots needed to be added to the labels of birth control options containing drospirenone, like Yaz, Yasmin, and Ocella.

A Danish study was conducted where they evaluated 1.3 million women. This study was published in the British Medical Journal. It also found that the birth control options that contained drospirenone were associated to a 6-fold increase in the side effect risk of developing a condition called venous thromboembolism. This is a condition in which blood clots actually form in the lower extremities of an individual, specifically the lower leg and thigh. These can break loose and at that point there is a risk that they will migrate to the lungs, which can be life threatening to the victim.

There have been over 12,000 Yaz, Yasmin and Ocella lawsuits filed against the birth control manufacturer Bayer. These Yaz, Yasmin and Ocella lawsuits have been filed by women who have experienced a number of negative side effects, including blood clots, strokes, pulmonary embolisms, or other side effects after using Yasmin, Yaz or Ocella. It has been reported that in 2011 the Bayer made birth controls, Yaz, Yasmin and Ocella, were the second most commonly named drugs in lawsuits. It has also been reported that Bayer has paid a whopping $402 million so far to settle many Yaz, Yasmin, and Ocella lawsuits but it is expected that the Bayer settlement budget will actually end up being in the billions.
