New Lipitor Lawsuit Accuses Pfizer of Negligence
By John Curran
A California woman says that drug maker Pfizer Inc. failed to warn her of the potential for elevated blood sugar levels while taking its popular cholesterol drug Lipitor, according to a new product liability lawsuit filed August 21, 2013.
Plaintiff Kathleen Davis began taking Lipitor in January 2010 and less than two years later she was diagnosed with insulin sensitivity and related conditions on October 27, 2011. According to her Lipitor lawsuit, Pfizer never warned patients about a potential relation between changes in blood sugar levels and the drug until a February 2012 label change mandated by the FDA.
In addition, the Lipitor lawsuit notes that thousands of other women who took the statin medication since the drug was approved in 1996 have suffered from similar issues. Lipitor type-2 diabetes side effect warnings now on the label are allegedly unclear, noting only “increases in … fasting serum glucose levels,” which may not adequately inform women who take the medication.
Pfizer acquired the company that originally owned Lipitor in 2000, but did not make the label change for 12 years – despite allegedly knowing about these potential Lipitor side effects from studies and drug injury reports. As a result, the Lipitor lawsuit alleges numerous counts of civil violations against the drug maker, including negligence, failure to warn, breaches of express and implied warranties, fraud and deceit by concealment, negligent misrepresentation, and violations of state statutes
Davis is seeking damages for pain and suffering for ongoing monitoring as well as for the drug maker’s inability to warn patients and doctors. In addition, her future earnings may be impacted by her diagnosis of Lipitor diabetes.
The Lipitor type-2 diabetes lawsuit is Kathleen Davis v. Pfizer Inc., et al., Case No. 13-cv-01724, U.S. District Court, Eastern District of California.
