Mirena Still Heavily Advertised Despite Growing Lawsuit Numbers

Although the number of Mirena IUD lawsuits is still growing, drug manufacturer Bayer continues to heavily advertise Mirena as a viable option for women seeking birth control. Bayer is already paying out millions of dollars in Yaz, Yasmin, and Ocella lawsuit settlements, yet they seem unfazed by the growing number of Mirena lawsuits filed against them. It has also been reported that Bayer made claims to their stockholders that birth control options are still generating a great deal of revenue for the manufacturer despite the birth control lawsuits. It leads many to wonder if Bayer has any concern at all for the safety of women or if it all comes down to dollar signs.
Commercials Still Fail to Mention Mirena’s Severe Side Effects
There are still commercials promoting Mirena being aired on a regular basis, and although they do mention some of the potential side effects of Mirena there is still no mention of the severe complications that have been raised Mirena injury lawsuits. These side effects are caused when the Mirena IUD birth control implant detaches from the place it is supposed to be and migrates to other areas of the woman’s body, causing severe damage. These injuries have also been life-threatening in some cases.
One of the main allegations in these Mirena lawsuits is that Bayer has made both misleading and false statements to potential users. However, it does not seem that Bayer is interested in changing their ways in order to protect women.
Bayer Dealt a Huge Blow in Mirena Lawsuits
Bayer, however, was recently dealt a blow in the Mirena lawsuit litigation process. They recently filed a motion to consolidate all of the Mirena lawsuits into a multidistrict litigation (MDL) – something that is traditionally done for a large numbers of cases to make the litigation process more efficient and consistent. But their motion was denied after strong objections from the plaintiffs. Why would the plaintiffs take a stand for something that is typically done to promote efficiency in the litigation process? Because Bayer had requested that the Mirena MDL be held in New Jersey, which also happens to be the location of Bayer’s headquarters where they employ many people. This could give Bayer an unfair advantage – something the plaintiffs were obviously not in agreement with and the judge evidently agreed.
There is still a strong chance that the Mirena lawsuits will be combined into a MDL, but in one that will be established in a neutral location.
