Mirena IUD Perforated Uterus, Lawsuit Plaintiff Claims

By John Curran

Mirena IUD migrationBayer Pharmaceuticals continues to argue that its Mirena intrauterine device (IUD) will not dislodge itself if it is properly installed. As Mirena lawsuits mount, yet another woman says that she has dealt with Mirena IUD spontaneous migration side effects that led to significant problems.

Notably, they occurred several years after her doctor first inserted the device. After the IUD dislodged and migrated through her body, Jessica Caruthers said that she dealt with severe side effects that included uterine perforation. In fact, the lawsuit she filed with the help of her Mirena injury lawyer notes that it had entered her abdominal cavity, leading to surgery in order to remove it and repair any damage. She alleges that Bayer has put a defective device on the market without adequately warning the public of its potential risks and side effects. Her Mirena lawsuit is alleging claims of product liability and failure-to-warn.

Whether or not the Mirena IUD is defective will likely depend on the standards used by the judge in the U.S. District Court of Kansas, where her lawsuit is filed. Many medical device makers say that federal Food and Drug Administration approval should mean that their products meet standards. Some jurists have begun to side with plaintiffs who say that due to delays and other problems at the agency, companies should warn consumers on their own about the risk of Mirena IUD spontaneous migration as well as other potential Mirena side effects.

While the extent of the damage Caruthers has dealt with is unknown, other problems linked to the device are extensive. Many women say that they have dealt with Mirena IUD side effects such as ectopic pregnancy and perforation of the uterus numerous organs. They also note that there is the potential for infertility, something that the website for Mirena does now note.

However, it required legal action and complaints from the FDA and a state attorney general to add this warning for Mirena infertility. Original advertising for the IUD said that it would make women look and feel great, although Bayer now includes warnings about the risk of Mirena IUD ectopic pregnancy and other side effects.

If women who developed these problems did not know of the risks involved, a free legal consultation could be the first step in obtaining a legal remedy to help with medical bills or lost wages.
