Mirena IUD Lawsuits Being Filed Across the U.S.

By Amanda Antell

Mirena injury lawsuitMirena IUD lawsuits continue to move forward in courts throughout the country. The allegations state that Bayer Healthcare Pharmaceuticals knowingly or ignorantly failed to communicate the problems associated with Mirena IUD to the women who received the birth control implant or to the medical community.

Approved by the FDA in 2000, Mirena is a t-shaped, plastic intrauterine device meant to prevent pregnancy for up to five years. It works by releasing the hormone levonorgestrel, preventing sperm to egg fertilization. IUDs are considered one of the most effective contraceptives, and are one of the most widely used.

Unfortunately, the Mirena IUD has caused damaging side effects in hundreds of women. The majority of these complications are caused by the IUD migrating after insertion and perforating the uterus and damaging organs. In some cases, infertility and ectopic pregnancy has been linked to Mirena.

In 2009, the FDA issued a warning letter to Bayer regarding their advertising campaign and promotional statements after finding the company had overstated the effectiveness of Mirena and minimized the risks that came along with it. Additionally, the FDA cited marketing claims, stating that Mirena IUD’s also falsely advertised that Mirena IUD would benefit a woman’s sex life.

Many women claim they have suffered extreme complications following their Mirena IUD implantations. The lawsuits allege that Bayer had been making misleading promotional statements while withholding information about the risks of uterus perforation, migration, and other serious problems. In cases where the Mirena IUD perforated uterine wall, the device had not only traveled outside the uterus, but had also damaged organs and caused infections. These complications called for emergency removal surgery of the Mirena IUD.

Complications from the IUD’s migration and the surgery to remove it also carry serious risks, and may lead to permanent injuries, which include but are not excluded to:

  • Abscess, infection
  • Tissue erosion
  • Infertility
  • Peritonitis
  • Intestinal perforations or obstruction
  • Uterine perforation
  • Embedment in the uterine wall
  • Ectopic pregnancy

This is not a complete list of Mirena IUD side effects. If a woman is suffering any kind of abnormality after inserting Mirena IUD, she should seek medical consultation immediately.

Current court records indicate that dozens of Mirena IUD lawsuits have been filed in state and federal courts by women who suffered serious injuries, all alleging the Mirena IUD was the cause of their injuries. According to a recent transfer order, the U.S. Judicial Panel on Multidistrict Litigation transferred all federally filed Mirena IUD lawsuits to U.S. District Court, Southern District of New York for pretrial proceedings.

These claims allege the Mirena IUD migrated away from its original position in the uterus, leading to uterine perforations, and other serious side effects. The plaintiffs further allege that Bayer failed to provide adequate warnings about the possibility of device migrations and other related side effects. Hundreds of women are filing lawsuits against Bayer Pharmaceuticals alleging safety failures and misrepresentation of Mirena side effects.
