Many Ocella Lawsuits May Not Have Been Filed Yet

Ocella lawsuitWith all the talk of Bayer trying to settle as many Yaz, Yasmin and Beyaz lawsuits as they can there is still a strong belief by many attorneys closely involved in the litigation process that many Ocella lawsuits have not been filed yet. If this information is accurate, this could be devastating to Bayer as it is already speculated that Bayer will be paying out over a billion dollars in Yaz and Yasmin lawsuit settlements. If there are a large number of Ocella lawsuits yet to be filed, this could affect that settlement budget greatly.

Ocella is one of the generic forms of Yasmin. There are also two others referred to as Syeda and Zarah. Ocella was originally developed in 2001 by Berlex Laboratories. However, Bayer Healthcare Pharmaceuticals acquired the drug in 2006. Like its non-generic equivalents, Yaz and Yasmin, it also contains drospirenone. This is considered a “fourth generation” progestin and is not contained in any other birth control pills on the market today.

Like the many Yaz and Yasmin lawsuits currently filed against Bayer, the Ocella lawsuits could be eligible for a settlement as well. However, many of these Ocella lawsuits have yet to be filed in order to receive that settlement. Many Ocella lawsuit attorneys believe this is due to a Supreme Court ruling on a previously filed Ocella lawsuit. In fact, it caused a great deal of uncertainty when it came to whether the Ocella lawsuits were eligible to filed or not as many perceived that the Supreme Court gave a blanket ruling over all Ocella lawsuits and could have led to an exemption provided by the Supreme Court.

What makes this situation so unique is that Bayer owns not only the name brand name versions of the birth control options but also the generic version as well. In June of 2012 an Ocella lawsuit went before the Supreme Court in the case referred to as Pliva Inc. v. Mensing. In a 5-4 decision the judges ruled that generic drug manufacturers are not liable for any inconsistencies in warning labels when it comes to side effects. But again, the issue comes to the fact that Bayer owns all three birth control options and, therefore, there is a strong argument that Bayer should have known the exact side effects and reported them properly. However, it is also important to note that Bayer has not appeared to have wanted to use the Supreme Court decision to argue against any of the Ocella lawsuits filed against them.

Like Yaz and Yasmin, Ocella has been linked to a number of side effects including the following:

* Blood clots
* Deep Vein Thrombosis (DVT)
* Gallbladder disease
* Heart attacks
* Pulmonary Embolism (PE)
* Strokes
