Is a NuvaRing Lawsuit Settlement On the Horizon?

There may be a light at the end of the tunnel for many women who have used NuvaRing and suffered blood clot injuries as a result. According to recent documents filed with the court for the New Jersey NuvaRing mass tort, nine NuvaRing lawsuits have been selected to go to trial as “bellwether” cases.
These nine NuvaRing lawsuits are scheduled to go to trial in February 2013. This frequently happens when there are a large number of lawsuits filed against one company and all for the same or very similar reasons.When a case is selected for bellwether, that means it will serve as sample case to determine how the rest of the lawsuits in the NuvaRing mass tort will be handled. If the jury awards a settlement in the trial case, it will affect how future NuvaRing lawsuit settlements will be awarded.
In the NuvaRing lawsuits, the Plaintiffs claim that the manufacturer of this drug, Merck & Co., and its subsidiary, Organon Pharmaceuticals, did not adequately warn patients about the risk of blood clots. Although it is well known that all hormonal birth controls create a slight risk of blood clots, studies show NuvaRing presents a higher risk of blood clots than other forms of birth control on the market.
NuvaRing is different from other hormonal birth controls because it is not a pill – it’s a plastic ring that is inserted vaginally. This is considered to be beneficial by many because it only has to be used once a month, instead of every day, and the patient can do it themselves. The idea is that NuvaRing will release hormones into the woman’s body in a steady manner. Some of the hormones released include:
* Estrogen
* Desogestrel – a type of progestin
Studies have actually indicated that it is the desogestrel in NuvaRing that causes the increased risk of blood clots, as well as other health related problems.
Hundreds of NuvaRing Lawsuits Have Already Been Filed
There are currently at least 100 NuvaRing lawsuits that have been filed in the NuvaRing mass tort pending Bergen County Superior Court. However, these don’t even scratch the surface when it comes to the approximately 800 NuvaRing lawsuits that have been filed in federal courts. These have been consolidated into a NuvaRing lawsuit MDL in the U.S. District Court for the Eastern District of Missouri.
There is still a big question on if all of the lawsuits will go to trial or if the makers of NuvaRing will enter into a settlement. What is known is that there have been several studies that have confirmed that NuvaRing does cause blood clots, and that is certainly going to help the Plaintiffs regardless of whether they go to trial or negotiate a NuvaRing settlement.
