Boston Scientific Mesh Lawsuit Alleges Severe Vaginal Sling Injuries

Arkansas resident Joyce Butler is suing Boston Scientific Corporation, Mentor Corporation and Mentor Worldwide LLC for personal injuries she allegedly suffered after being treated with the Mentor OB Tape Sling, the Boston Scientific Repliform and Boston Scientific Obtryx sling.
According to the vaginal sling lawsuit, Joyce was implanted with Mentor OB Tape Sling on April 21, 2006, the Boston Scientific Repliform on November 17, 2008, and the Boston Scientific Obytryx sling on May 4, 2009. All surgeries were performed at St. Vincent Infirmary in Little Rock, Arkansas.
The abovementioned products were implanted to treat Joyce for stress urinary incontinence. The vaginal sling products were designed, marketed and sold for the purpose of treating medical conditions like Joyce’s.
The vaginal sling lawsuit states that “as a result of having the products implanted in her, Plaintiff has experienced significant mental and physical pain and suffering, has sustained permanent injury, permanent and substantial physical deformity, has undergone and will undergo corrective surgery or surgeries, has suffered financial or economic loss, including, but not limited to, obligations for medical services and expenses, and present and future lost wages.”
In her vaginal sling lawsuit, Joyce alleges that the defendants negligently and carelessly designed, manufactured, labeled, tested, examined, distributed, advertised, marketed, promoted, sold and/or supplied the products that were dangerous and unsafe for the uses and purposes for which they were intended.
Because defendants continue to market and sell the products under question, the vaginal sling lawsuit contends that the defendants “showed complete indifference to or a conscious disregard for the safety of others.” Allegedly, this action justifies an award of punitive damages that would punish and deter same conduct in the future.
