Another NuvaRing Lawsuit Filed Over Dangerous Side Effects

Another NuvaRing lawsuit has been filed by a woman who suffered serious side effects of the contraceptive device. Her case joins more than 950 NuvaRing lawsuits pending in federal courts across the United States.

Ohio Plaintiff Elizabeth Burton alleges in the NuvaRing side effects lawsuit that the makers of the birth control device put her at an unreasonable risk of injury in a number of ways, including by not properly testing the hormones used in NuvaRing, and by failing to warn her and the public about the serious risks of developing NuvaRing side effects such as dangerous blood clots, pulmonary embolism, deep vein thrombosis and even death. Burton’s NuvaRing lawsuit also accuses the drug manufacturers of marketing and selling a defective product.

NuvaRing has been linked to numerous serious side effects caused by the hormone etonogestral, a synthetic third-generation progestin that changes a person’s blood clotting system. Etonogestral puts NuvaRing users at a higher risk for developing a dangerous blood clot than older forms of birth control pills. A June 2012 study published in the British Medical Journal found that NuvaRing users are 90% more likely to have a dangerous blood clot than women who use the pill.

NuvaRing blood clot injuries include deep vein thrombosis (DVT) — a blood clot in the deep vein of your body, usually in the legs or pelvis — and pulmonary embolism (PE), a blockage of one or more arteries in the lung usually caused by DVT blood clots dislodging and traveling to the lung. NuvaRing blood clots can cause life-threatening complications such as heart attack, stroke and even death.

Nearly 1,000 lawsuits have been filed by NuvaRing users who claim the drug manufacturers were aware of these blood clot risks but failed to adequately warn consumers, and actually marketed NuvaRing as just as safe as birth control pills. Many of these NuvaRing lawsuits also accuse the drug makers of defective product design, saying the foreseeable risks of NuvaRing exceeded the benefits associated with its design or formulation. These defective NuvaRing lawsuit claims also allege the contraceptive device had unnecessary dangerous hormones and released uneven amounts of these hormones, and that the Defendants could have used alternative designs that would have prevented and/or significantly reduced the risk of Plaintiffs’ injuries without impairing the function of NuvaRing.
