Actos Bladder Cancer Victim Sues Pharmacy

By John Curran

Actos cancer side effectsState laws are different from federal laws and several key additions to a West Virginia statute are the reason an Actos bladder cancer lawsuit lawyer wanted to file a claim there, rather than in federal court. A U.S. District Court judge agreed with the rationale, in spite of claims by the Type 2 diabetes drug’s maker, Takeda Pharmaceutical.

West Virginia, like California and some other states, allows plaintiffs who have suffered from Actos side effects and those of other drugs to sue parties beyond the pharmaceutical manufacturers themselves. In this case, Richard Myers and his legal team targeted a local pharmacy that he said did not warn of him the carcinogenic properties of the diabetes medication. However, Myers would not have been able to sue for the drug itself.

Instead, his Actos bladder cancer lawsuit lawyer argues that the West Virginia drug store did not warn the man of the risk of developing the disease. That is allowed according to state statutes, and could put other drug stores on notice, not just in the Mountaineer State but throughout the country. It also helps people who may be entitled to a larger legal remedy than if they had filed a claim against the manufacturer alone.

Risks go beyond Actos bladder cancer side effects, however. While there is strong medical research indicating that the drug can lead to the need for chemotherapy or organ removal, there are similar well-support claims for other conditions. These include Actos bone fracture risks, especially for women, as well as congestive heart failure risks. The FDA has noted the latter, and Takeda Pharmaceutical has noted that its drug mimics another maker’s in reducing bone density.

All of these Actos side effects have been noted by plaintiffs in the hundreds of Actos injury lawsuits that have been filed against the manufacturer. It could grow even more thanks to the appearance of generic versions that are less expensive, and therefore more accessible to less well-off Americans.

People who have dealt with Actos bladder cancer or other serious side effects caused by the Type 2 diabetes medication should consider their legal options. A free consultation with an Actos lawsuit lawyer is available at the Actos Bladder Cancer Class Action Lawsuit Investigation. Filling out the short form there enables former users to determine whether or not they are eligible to pursue a claim. Hundreds have done the same and it is imperative to act now and contact an Actos lawsuit lawyer for the fastest possible resolution of a case.
