Actos Bladder Cancer Lawsuit Filed By Illinois Man

By Andrea Gressman

Actos bladder cancerThomas Boswell of Illinois filed an Actos lawsuit against pharmaceutical company Takeda on August 28, 2012 in the Circuit Court of Cook County Illinois. Judge William Maddux is overseeing the case. His Actos lawsuit claim Takeda failed to warn about the risk of developing Actos bladder cancer.

The Actos lawsuit stated that Boswell took Actos as a treatment for his Type 2 diabetes, as it is designed to help manage blood sugar levels in diabetics. Boswell’s Actos lawsuit then claims that the Actos medication subsequently led to his development of bladder cancer. He blames Takeda, who manufactures Actor, for failing to adequately warn patients of the dangerous side effects of Actos, including the risk of developing bladder cancer.

Actos Recalled in Europe, But Not U.S.

In 2011, an assessment of the five-year interim results of an ongoing 10-year study discovered that Actos increases the risk for bladder cancer by 40% if used for more than 12 months. Germany and France recalled Actos after a French study discovered similar results in their findings. However, despite the known risks, no U.S. recall of Actos has occurred.

The FDA ordered Takeda to include the potential risks for Actos bladder cancer in the drug’s label. Additionally, doctors are not advised to prescribe Actos to patients with a history of bladder cancer.

Actos Lawsuit MDL Established

In addition to Boswell, many others have filed Actos lawsuits after contracting bladder cancer allegedly caused by using Actos. As a result of this plethora of Actos bladder cancer lawsuits, an Actos lawsuit MDL was established by the Judicial Panel on Multidistrict Litigation in the Western District of Louisiana. November 3, 2014 is the scheduled date for the first bellwether trial in the Actos lawsuit MDL, while the second is set for January 12, 2015.

Determine Your Actos Lawsuit Eligibility

Diabetes patients who have used Actos and have suffered from adverse Actos side effects are advised to contact a knowledgeable Actos lawsuit attorney to determine eligibility for filing an Actos lawsuit or Actos class action lawsuit and receiving compensation for the pain and suffering they’ve endured.

To determine eligibility, an Actos bladder cancer attorney must consider if the patient was informed of the risks and side effects of Actos before taking the drug, the duration of time using the drug, if the drug was used properly according to instructions, the nature of side effects and the time they surfaced, and whether the symptoms of Actos bladder cancer could have surfaced outside of Actos use. If it is determined that your bladder cancer was caused by using Actos then you would be able to file an Actos lawsuit and possibly join the Actos lawsuit MDL. You may also have a case to file an Actos class action lawsuit.

If you or someone you love has been diagnosed with bladder cancer and have a history of using Actos, it is important to contact a qualified Actos bladder cancer lawsuit attorney right away.
