AbbVie Humira price class action lawsuit overview: 

  • Who: Edward Camargo filed a class action lawsuit against AbbVie Inc. 
  • Why: Camargo claims AbbVie has unlawfully inflated the price of its autoimmune, rheumatologic, and gastrointestinal disease drug Humira.
  • Where: The class action lawsuit was filed in Illinois federal court.

AbbVie has inflated the price of the autoimmune, rheumatologic, and gastrointestinal disease drug Humira to the point where it is no longer affordable for many patients, a new class action lawsuit alleges. 

Plaintiff Edward Camargo claims AbbVie is defying state laws “prohibiting unfair and unreasonable prices” with its “unfair and unconscionable inflation of Humira’s list (or point of sale) price in the United States.” 

Camargo argues AbbVie is working with pharmacy benefit managers (PBMs) — including CVS Health, Express Scripts, and OptumRX — to “widen a secret spread between AbbVie’s published list prices and the undisclosed net selling prices for Humira.” 

“Knowing that PBM profits are tied to the size of the spread between list price and net selling price, AbbVie has offered the PBMs higher spreads in exchange for preferred positions on the PBMs’ drug formularies,” the AbbVie class action states. 

Camargo wants to represent a nationwide class of consumers who have paid any portion of the purchase price for a prescription of Humira at a price that was calculated by reference to a list price and who had to stop taking the drug after losing insurance coverage. 

AbbVie’s alleged scheme caused Humira to double in price with no corresponding increase in production costs, says class action

Camargo argues AbbVie’s alleged scheme caused the list price for Humira to double during a five year period from January 2015 to January 2020, increasing from approximately $1,700 per month to $3,400 per month. 

This jump in price occurred without any “corresponding material increase in the actual costs of the production,” the AbbVie class action alleges.

“Prices are now so high that despite being prescribed, many Humira patients simply can’t afford it,” the AbbVie class action states. 

Camargo claims AbbVie is guilty of violating laws from a number of states that have a focus on consumer protection, consumer fraud, unfair and/or deceptive trade practices, and unfair competition. 

Plaintiff is demanding a jury trial and requesting declaratory and injunctive relief along with an award of treble and punitive damages for himself and all class members. 

A separate class action lawsuit was filed against AbbVie in June 2022 by an investor arguing the company made false statements to its shareholders about its rheumatoid arthritis drug Rinvoq.

    I have been taking Humira for 5 years. My insurance was charged so much money. Middle of last year I was told that I could no longer use the $5 copay card because I had “used up all the benefits for the year”. Had to wait until this year to be able to use the $5 card again.

    This is so unfair. I’ve been on Humira for several years now and it’s so expensive.

    My insurance company is charged over $7400 a month for two Humira pens. The price is outrageous.

    Why is it that you can’t use the Humira coupon when on Medicare. That’s when you need it. I pay about $6,000 a year now compared to $60 a year with coupon.

    I have been on Humira since 2012. When I was working, I had to pay a high deductible the first prescription of the year and the $5 co-pay each month after. I became disabled and now receive SSDI and Medicare and qualify for the assistance program through AbbVie. I wouldn’t be able to afford it otherwise.

    I used Humira since 2017….. it was costing me a $5 copay fee. By 2018, it was going up higher. I couldn’t afford it and I got extremely sick where I had to go to the hospital. It was extremely bad. Humira isn’t good for me.

    I use Humira 2 times a month. I get my script filled through Express Scripts.

    I’m 36 years with Psoriatic Arthritis and finally found Humira relief just a couple of years ago when I was 64 years of age. The pharmacist at my insurance’s Specialty Pharmacy knew of a Abbvie program that allowed me to receive the Humira at $5 per 2-pack (30 day supply) of injection pens. As soon as I went on Medicare at age 65 I was informed that the $5 copay program could no longer apply. I started having to pay as much as over $2000 for a 30 day supply while being told that the list price was over $6000. I did apply for a free Humira program through Abbvie and did not qualify for the year I turned 65 (2022) but ultimately got approved in February of 2023. Many thousands of dollars spent in between!
