DePuy ASR hip settlementOn Tuesday, Nov. 19, the judge overseeing the DePuy ASR hip MDL will review the terms of a proposed $4 billion settlement offered to settle thousands of lawsuits alleging the Johnson & Johnson unit sold metal hip replacement systems prone to premature failure.

It has been reported that the terms of the DePuy hip settlement would allow DePuy and Johnson & Johnson to have a right to cancel the settlement as long as at least 94% of those with pending hip implant lawsuits agree to partake in the settlement. There have even been rough estimates stating that an individual with a valid claim could be granted anywhere between $300,000 and $350,000. This money will be determined by a “scale” that will grant more to those with more serious hip replacement complications or those that had bilateral revision over those who did not.

Since this is not a class action settlement, each individual person with a lawsuit in the DePuy hip MDL will have to agree to participate in the settlement. Currently, it is estimated that this settlement applies to the 12,000 pending lawsuits regarding DePuy ASR hip implants in U.S. courts.The DePuy ASR hip replacement was advertised to last 10 to 20 years but it has been determined that every 1 out of 8 people who received the device had to have it replaced as early as in the first 5 years. For those who have received the hip implant but not yet experienced an implant failure may be able to gain compensation in the future as well, but it is also possible that they may just receive minimal compensation at a “one-time” payout.

The DePuy ASR metal on metal hip implant was originally recalled back in 2010 due to numerous reports of failure resulting from metal debris from the implants causing severe damage to bones and tissue surrounding. The metals chromium and cobalt deteriorate from the implant and move on into the bloodstream to attack nearby cells. This process is called metallosis.

    This amount of money sounds a lot to some, but it is peanuts compared to what a health professional can earn in a life time. This is an insignificant amount to compensate someone who has suffered permanent damage by De-puy hip implants. The pain ,the suffering, the debilitation, low self esteem and the long term financial burden it leaves. The enjoyment one loses in life through this is uncountable; future health implications; the significant reduction in quality of life will continue to torture all sufferers for rest of their life. We should fight for more to punish those who only care company profit first, and risk innocent people life.
