Update:

  • An $83 million settlement has been reached in a class action lawsuit filed against several entities involved in the maintenance and construction of the Surfside building that collapsed.
  • Each owner of the building’s condominiums will receive $50 million from the settlement pool as compensation for their condos and contents. Once the settlement pool reaches $100 million, they will receive the remaining $33 million. Per the settlement, owners will be relieved from liability for injury and wrongful death claims, which would typically happen under Florida state law.
  • The settlement must still be approved by the court. The final approval hearing is on Mar. 30.

  • Why: Miami-Dade Circuit Judge Michael A. Hanzman has allowed an extension on the trial date after the defendants’ attorneys said they would not be able to finish their investigation until December.

After originally hoping to start a trial this year over the collapse of the Champlain Towers South condominium in Surfside, Florida, which killed 98 people, a judge has agreed to push the trial back to March 2023. 

During a status conference held on Zoom Jan. 5, Eleventh Circuit Judge Michael A. Hanzman said he would “reluctantly” extend the trial date by six months, after hearing from the defendants’ attorneys who said their investigation would not be complete until December, Law360 reported.

Hanzman had originally hoped to have the case go to trial by summer 2022 at the latest, telling counsel they must “roll up their sleeves and get moving.” 

However, at the hearing, Greenberg Traurig LLP’s David Weinstein, who spoke on behalf of the defendants, told the court that experts would not be finished on the collapse site until December and then needed further time to file reports. He asked for a delay to September 2023, but Judge Hanzman said that was far too long.

No Further Delays To Be Granted, Judge Says

In granting the extension to March 2023, the judge said no further delays would be granted unless there were serious extenuating circumstances.

“That is a firm deadline ladies and gentlemen so do not bank on any continuances,” he reportedly said.

The defendants in the case so far include the Champlain Towers South Condominium Association, its lawyers Becker & Poliakoff PA, engineering firm Morabito Consultants Inc. and the builders of neighboring condos Eighty Seven Park.

They say those builders performed destructive work dangerously close to Champlain Towers.
