Florida Condo Collapse Class Action Lawsuit Overview:

  • Who: Victims of the Champlain Towers South condominium will have their case go to trial by summer 2022
  • What: Miami-Dade Circuit Judge Michael A. Hanzman has reiterated the case will not be “business as usual” with extended deadlines and lengthy processes. He has told counsel they must “roll up their sleeves and get moving.”
  • Where: Florida

A class action lawsuit filed by victims of the collapse of the Champlain Towers South condominium in Surfside, Florida, which killed 98 people, will go to trial by summer 2022 at the latest, a Florida judge has said.

Miami-Dade Circuit Judge Michael A. Hanzman has said the case will not be “business as usual” and the courts will move forward without extensions, Law360 reports, although Hanzman did extend the deadline for defendants, including the newly added defendants, by two weeks in order to respond to an amended complaint.

“Do not let that delay your preparation,” he warned plaintiffs’ co-chair and Grossman Roth Yaffa Cohen PA Partner, Rachel Furst.

“Get your discovery out … and you all better roll up your sleeves and get moving, because come next summer we’re going to be picking a jury in this case to the extent these claims survive.”

Hanzman had previously told counsel for both the defendants and the plaintiffs that they should only take the case if they were willing to meet the court’s tight schedule, and able to “throw all the resources you need at it to be ready for trial by next summer, because it’s not going to go beyond that.”

Hanzman said that he will issue a trial order at the first hearing in January, and that the trial would likely take place in July or August.

Furst advised the judge that the plaintiffs’ counsel was working with the defendants’ counsel to make sure discovery responses were comprehensive and that deadlines in the case were set. She added that plans to sell the oceanfront property, which collapsed on June 24, were underway. Mediation efforts into how to divide funds from the sale between victims is already a point of contention among potential class members, Law360 reports.
