West-Aircomm Federal Credit Union (WAFCU) agreed to pay $300,000 to resolve claims it failed to properly inform borrowers of their rights after vehicle repossession.Â
The settlement benefits borrowers on secured WAFCU auto loans who were sent certain notices between June 13, 2013, and May 7, 2019, after their vehicle was repossessed.Â
Plaintiffs in the class action lawsuit accused West-Aircomm of failing to send borrowers the proper repossession notices and deficiency calculations required by lending laws. These insufficient notices allegedly caused consumers financial harm.
West-Aircomm Federal Credit Union is based in Pennsylvania.Â
West-Aircomm hasn’t admitted any wrongdoing but agreed to a $300,000 class action settlement to resolve the repossession notice allegations.Â
Under the terms of the WAFCU settlement, class members can receive a proportional cash payment from the net settlement fund. Exact payments will vary.Â
A second round of payments may be distributed if more than $30,000 remains in the settlement fund after the first round of payments.
If less than $30,000 remains in the settlement after payments are distributed, these funds will be paid to Pennsylvania Interest on Lawyers Trust Account, Neighborhood Legal Services based in Pittsburgh and Alliance for Consumer Protection, Beaver County.
The settlement also offers credit reporting relief. Unless class members reinstated their loans, West-Aircomm will request that all reporting agencies remove any reference to the auto loan on class member credit reports.Â
The deadline for exclusion and objection is April 13, 2023.
The final approval hearing for the settlement is scheduled for June 9, 2023.
No claim form is required to benefit from the WAFCU settlement. Class members can update their addresses on the settlement website to ensure they receive their payments.
