Good Samaritan Hospital agreed to a class action settlement to resolve claims it failed to prevent a data breach.
The settlement benefits California residents who were mailed a notice of a Good Samaritan Hospital data breach in June and July 2020.Â
Plaintiffs in the data breach class action lawsuit claim Good Samaritan Hospital could have prevented the data breach through reasonable cybersecurity measures but failed to protect its patients. As a result, sensitive information such as patient names, birth dates, Social Security numbers was allegedly compromised.
Good Samaritan Hospital is a hospital and emergency room in San Jose, California.Â
Good Samaritan Hospital hasn’t admitted any wrongdoing but agreed to pay an undisclosed sum to resolve the data breach class action lawsuit.
Under the terms of the settlement, class members can receive a cash payment of up to $1,500 for documented data breach-related expenses. Eligible expenses include bank fees, interest on payday loans, mileage, communication charges, credit-related costs and more.Â
Class members who experienced extraordinary expenses from identity theft, medical fraud, tax fraud or other forms of fraud can receive higher payments of up to $5,000 in reimbursement for fraudulent losses.
All class members can receive two years of free identity monitoring services from Experian, even if they did not suffer from any losses. Experian identity monitoring includes up to $1 million in identity theft insurance and fraud resolution services.
Good Samaritan has also agreed to make data security policy improvements to better protect patient information. These improvements are valued at $459,921.51 and will be completed within 90 days of the settlement’s effective date.
The deadline for exclusion and objection is July 18, 2023.
The final approval hearing for the settlement is scheduled for Sept. 5, 2023.
In order to receive settlement benefits, class members must submit a valid claim form by July 18, 2023.
