The U.S. Equal Employment Opportunity Commission (EEOC) approved a $15 million settlement to resolve claims that the U.S. Marshals Service (USMS) discriminated against African Americans.

The settlement benefits current and former African American deputy U.S. marshals who were subjected to USMS promotion policies under the Merit Promotion Process, Management Directed Reassignments and Headquarter Division assignments between Jan. 23, 1994, and Nov. 27, 2023.

The settlement also benefits current and former African American deputy U.S. marshals, detention enforcement officers or applicants who were subjected to USMS hiring and recruitment policies for deputy U.S. marshal positions between Jan. 23, 1994, and Nov. 27, 2023.

Plaintiffs in the case claim the U.S. Marshals Service discriminated against them based on their race. Because they are African American, the plaintiffs were allegedly denied promotions, employment and other benefits.

The U.S. Marshals Service is a federal law enforcement agency.

The U.S. Marshals Service hasn’t admitted any wrongdoing but agreed to a $15 million settlement to resolve the discrimination claims.

Under the terms of the EEOC settlement, eligible consumers can receive a monetary award. Pro rata payments will be distributed based on eligible backpay, compensatory damages and other factors determined by the settlement administrator. 

No payment estimates are available at this time, but claimants could receive more than $100,000, depending on their eligibility.  

The deadline for objection is Jan. 11, 2024. There is no exclusion deadline for the settlement.

The final approval hearing for the U.S. Marshals EEOC settlement is scheduled for March 20, 2024.

To receive a settlement payment, current and former eligible workers must submit a valid claim form by Jan. 26, 2024.

    Where in the United States does it take more than a month to receive a check. Even if they walked it from Cali to Chicago we would have had it by now. They said July 8 and now its July 30. Something is fishy, this is horrible.

    If you haven’t received your payment, call the class counsel Sandford Heishler and Sharp LLC. (202)759-0802…. Listen to the voice message and afterwards it will give you an opportunity to leave a message. Let them know you have not received payment and that the claims administrator is not returning calls or providing updates. Leave your name and number and they will contact you quickly. Let them know that you’re a verified class member and completed your W9 form.

        I have called and talked to both administrator and class counsel both said my check was mailed on July 8th and if I don’t get it by early August then I should ask for them to re issue it and that them checks will go out in October.so im waiting a little longer to see if it comes because I don’t want to wait till October to get it re issued. let me no if any one is still waiting like me thank you

    The Class Administrator involved in this lawsuit has handled the settlement process in a manner that has left many verified class members frustrated and disappointed. Calls to the published telephone number routinely go unanswered, voicemail messages are not returned, and no meaningful updates or explanations have been provided regarding the status of settlement payments.

    Many of us have waited for years for this litigation to conclude. After being informed that settlement payments were mailed on July 8, 2026, a significant number of verified class members still have not received their payments. As a result, we have no way of knowing whether the checks were mailed, delayed by the postal service, sent to an incorrect address, lost, stolen, or otherwise affected. The lack of communication has only increased uncertainty and concern.

    Several class members have also attempted to contact Class Counsel for assistance but have received little or no response. While we recognize that settlement administration can be a lengthy and complex process, verified class members deserve timely communication, transparency, and basic customer service. Simply acknowledging concerns and providing periodic updates would go a long way toward restoring confidence in the administration of this settlement.

    Because of the continued lack of communication, many class members have filed formal complaints with the Claims Administrator, contacted the Court that presided over this case, and sought assistance from independent legal counsel. These actions are not being taken out of impatience, but out of frustration with the absence of information and accountability.

    In our opinion, the handling of communications throughout this final stage of the settlement has been unprofessional and has left many verified class members feeling ignored and undervalued. We respectfully request immediate transparency regarding the status of outstanding settlement payments, an explanation for the delays, and regular updates until every eligible class member has received the compensation awarded under the settlement.

      i still have not received mine either it’s very upsetting .talked to the administrator today she said it was mailed and if I want to cancel it and have a new one issued I saw no because she said the new one would not be sent until october.so I’m waiting a little bit longer to see if it comes.
