The U.S. Equal Employment Opportunity Commission (EEOC) approved a $15 million settlement to resolve claims that the U.S. Marshals Service (USMS) discriminated against African Americans.
The settlement benefits current and former African American deputy U.S. marshals who were subjected to USMS promotion policies under the Merit Promotion Process, Management Directed Reassignments and Headquarter Division assignments between Jan. 23, 1994, and Nov. 27, 2023.
The settlement also benefits current and former African American deputy U.S. marshals, detention enforcement officers or applicants who were subjected to USMS hiring and recruitment policies for deputy U.S. marshal positions between Jan. 23, 1994, and Nov. 27, 2023.
Plaintiffs in the case claim the U.S. Marshals Service discriminated against them based on their race. Because they are African American, the plaintiffs were allegedly denied promotions, employment and other benefits.
The U.S. Marshals Service is a federal law enforcement agency.
The U.S. Marshals Service hasn’t admitted any wrongdoing but agreed to a $15 million settlement to resolve the discrimination claims.
Under the terms of the EEOC settlement, eligible consumers can receive a monetary award. Pro rata payments will be distributed based on eligible backpay, compensatory damages and other factors determined by the settlement administrator.
No payment estimates are available at this time, but claimants could receive more than $100,000, depending on their eligibility.
The deadline for objection is Jan. 11, 2024. There is no exclusion deadline for the settlement.
The final approval hearing for the U.S. Marshals EEOC settlement is scheduled for March 20, 2024.
To receive a settlement payment, current and former eligible workers must submit a valid claim form by Jan. 26, 2024.

I was able to speak to the class administrator after they called me back on my verification.
For those who asked me, here is the breakdown.
33% to pay attorneys
70% to class members
of that 70%, there are hiring claims and promotion claims
so there is also backpay awards tied to the diffrence between what they could have made and actually did. That amounts to $962 per year.
Then for promotions, that is done pro rata.
Each class member gets $5000 just from the jump to cover promotions.
Then they move to Compensatory Damages.
Each Class Member gets – minimal emotional distress damages, awarded $5,000; moderate
emotional distress damages, awarded $25,000; severe emotional
distress, awarded $100,000.
So it appears the minimum each class member is getting is close to $10k.
If after doing all their calculations, it exhausts the funds, the awards will be lowered pro rata to meet the amount of money in the fund.
Checks went out July 8th and you should start seeing them arrive this weekend and next week. She didnt tell me if they are doing batches, that was a question I thought to ask after the fact.
