TransUnion Rental Screening Solutions agreed to an $11.5 million settlement to resolve claims that it included inaccurate information in its consumer reports.

The settlement benefits two classes: the Policy Settlement Class and the Money Settlement Class.

The Policy Settlement Class is made up of individuals for whom TransUnion Rental Screening Solutions reported a criminal record and/or landlord-tenant record to a third party since Nov. 7, 2016.

The Money Settlement Class includes the following groups:

  • Age Mismatch Group: Individuals who had a criminal record that did not belong to them reported by TransUnion Rental Screening Solutions to a third party between Nov. 7, 2016, and Jan. 1, 2022, despite the offender age information being older than the report subject. 
  • State Criminal Group: Individuals who had a criminal record from California, Florida, Texas or Utah reported by TransUnion Rental Screening Solutions to a third party between May 14, 2019, and Jan. 1, 2022, where the record did not contain a date of birth, Social Security number of street address.

According to the class action lawsuit, TransUnion Rental Screening Solutions included false information in consumer reports which wrongfully attributed criminal records and evictions to consumers. These false reports allegedly violated the federal Fair Credit Reporting Act (FCRA).

TransUnion Rental Screening Solutions provides tenant screening for property owners.

TransUnion hasn’t admitted any wrongdoing but agreed to a $11.5 million settlement to resolve the class action lawsuit. The settlement has two portions: the policy portion and the money portion.

Under the policy portion of the settlement, TransUnion agreed to change its rental screening practices to not match criminal records to consumer reports unless this information can be verified. The credit bureau also agreed to change the formatting of its landlord-tenant records and make additional changes for more accurate reporting. 

Under the money portion of the settlement, class members can receive a proportional share of the net settlement fund based on their class group membership. Payments will vary depending on the number of settlement shares allocated to each class member.

Members of the Age Mismatch Group with felonies, sex offenses and sex offender records, State Criminal Group Valid Claimants with felonies, sex offenses and sex offender records and/or Criminal Disputes Group will receive 10 settlement shares. 

Members of the Age Mismatch Group with misdemeanors, non-felonies and non-sex offenses, State Criminal Group Valid Claimants with misdemeanors, non-felonies and non-sex offenses and/or Eviction Disputes Group will receive two settlement shares. 

Members of the State Eviction Group will receive one settlement share. 

The deadline for exclusion and objection is June 30, 2023.

The final approval hearing for the settlement is scheduled for Sept. 21, 2023.

Although no claim form is required to benefit from the policy portion of the settlement, class members must submit a valid claim form by June 30, 2023, to receive a cash payment if they fall in the State Criminal Group or Age Mismatch Group.

    These lawsuits annoy me. How are supposed to know exactly the reasons for the denial or the credit Bureau used? Almost all of the Property Management (money grabbers, not landlords) companies we have received denials from never gave us a reason, never sent a letter or a detailed response as to the who what when or why. In many cases, these places accept as many applicants as possible to collect fees ( profit) just to deny you , knowing all along who they intend to rent to. Whatever happened to , “First come , first served” and move down the line? Now it’s hoard applications, collect a mass amount of money and ; oh, good luck. I’m over the whole process. Yet, people don’t understand this IS just one part of the homelessness problem.
