Texas residents who received medical treatment at a hospital that was in-network according to their health insurance plan and received emergency services affiliated with Envision Healthcare Corp. may be eligible for a refund, write-off, and/or clear disclosures in the future thanks to a recent class action lawsuit settlement.
Settlement Class Members include individuals who went to a hospital that was in-network in Texas and received emergency services from Envision Healthcare Corp. or its affiliates between July 9, 2015, and Jan. 29, 2021. Class Members affected by this class action lawsuit should have received a notice by mail regarding their status.
Plaintiffs in a class action lawsuit allege the defendants acted in violation of Texas law by overcharging patients for emergency healthcare services.
The company denies it overcharged patients for emergency services. Further, it denies allegations it violated Texas law, and it does not claim any legal liability in this matter.
The Court has not made a ruling in this case, so no determination of innocence or guilt was made.
Rather than continuing on with the Envision lawsuit, both parties have decided the proposed settlement agreement is in everyone’s best interests.
Per the class action settlement, Class Members are eligible to receive a write-off if the defendants or a collection agency is currently attempting to bill them or collect money for the rendered services.
The write-off will cancel the difference between what the Class Member was charged and the allowable charge, the reimbursement from the Class Member’s insurance company, as long as they have not received that reimbursement yet.
Class Members who already paid more than the allowable charge are eligible to receive a refund.
This refund will cover any payment the Class Member made that exceeded the allowable charge and will cover any additional fees paid to a collection agency or a third party.
On top of write-offs and refunds, clear disclosures will be in place in the future.
The defendants have agreed to request in writing that hospitals allow certain disclosures to be posted in the waiting area in emergency rooms and in bold print on documents provided to patients.
Eligible Class Members must submit a claim form to receive any refunds or write-offs. In addition to the claim form, Class Members should send in supporting documentation to prove their claims.
A final fairness hearing in the Envision emergency services class action lawsuit settlement is scheduled to take place Nov. 19, 2021.
The deadlines for opting out of or objecting to the Texas Envision class action settlement have passed.
The deadline to file a claim is April 25, 2022.

- An explanation of benefits (EOB) regarding your claim or claims for out-of-network emergency services provided by a physician practice affiliated with Envision.
- Proof of any payments for those out-of-network services.
- If the allowable charge has not been paid, then payment of the allowable charge or the unpaid portion there of must be made.
- If you were sent to collections, a copy of the invoice or invoices from the collection agency and proof any payment made to them.
