10UP agreed to a class action lawsuit settlement to resolve claims that a data breach affected San Francisco Employee Retirement System (SFERS) participants’ information.Â
The settlement benefits San Francisco Employee Retirement System (SFERS) members who received a data breach notice disclosing the fact that 10UP discovered a breach of its test server in February 2020.
In February 2020, 10UP was the victim of a data breach that reportedly compromised the names, bank information and other personal data of 74,000 SFERS participants and beneficiaries. According to plaintiffs in the data breach class action lawsuit, 10UP could have prevented or mitigated the attack by taking reasonable cybersecurity measures.Â
10UPS is a vendor of the San Francisco Employee Retirement System (SFERS).
10UP hasn’t admitted any wrongdoing but agreed to pay an undisclosed sum to resolve the SFERS data breach class action lawsuit.
Under the terms of the 10UP settlement, all class members can receive a $60 cash payment and a year of free credit monitoring and identity theft protection services offered by IDX.
Class members who experienced documented data breach-related losses may be able to recover additional compensation. Affected SFERS members can claim up to $1,000 for extraordinary losses related to the breach, including the costs of fraud, identity theft and up to three hours of lost time (compensated at a rate of $25 per hour).
The deadline for exclusion and objection is Oct. 25, 2023.
The final approval hearing for the 10UP settlement is scheduled for Jan. 18, 2024.
In order to receive settlement benefits, class members must submit a valid claim form by Oct. 25, 2023.
