Southern Wine & Spirits agreed to a $5.5 million settlement to resolve a class action lawsuit claiming that it charged higher late fees than allowed by California law. 

The settlement benefits California consumers and businesses who were Southern Wine & Spirits customers between June 13, 2020, and June 30, 2023.

According to the class action lawsuit, the company violated California liquor laws by charging 2% on late payments. Under California law, the company was only allowed to charge 1% per month, the class action lawsuit contends.

Southern Wine & Spirits is a national liquor distributor known as Southern Glazer’s Wine & Spirits following a 2016 merger with Glazer’s. 

Southern Wine hasn’t admitted wrongdoing but agreed to a $5.5 million settlement to resolve the late fee class action lawsuit. 

Under the terms of the settlement, class members can receive a proportional share of the net settlement fund based on the amount they paid in carrying charges during the settlement period. 

The company also agreed to write off $44.1 million in pending late fees charged against consumer accounts. The company agreed to charge only 1% late fees going forward, as allowed by California law.

The deadline for exclusion and objection is March 1, 2024.

The final approval hearing for the settlement is scheduled for April 16, 2024.

No claim form is required to benefit from the settlement. Class members who do not exclude themselves will automatically receive a settlement check.
