A settlement has been reached in a class action lawsuit against Salud Family Health that claimed the company failed to protect its customers’ personally identifiable information during a data breach in which an unauthorized third party gained access to the company’s systems.

The settlement class is made up of patients or anyone affiliated with Salud Family Health whose personal information may have been accessed during the data security incident that happened on or around Sept. 5, 2022.

By allowing the security breach, the plaintiff asserted, Salud Family Health was guilty of negligence, negligence per se, breach of implied contract, breach of fiduciary duty, intrusion upon seclusion/invasion of privacy, unjust enrichment, declaratory judgment and violation of the Colorado Consumer Protection Act.

The private information that was allegedly compromised included names, Social Security numbers, driver’s license numbers, Colorado identification card numbers, financial account information, credit card numbers, passport numbers, medical treatment and diagnosis information, health insurance information, biometric data, usernames and passwords.

Salud Family Health is a Federally Qualified Health Center and 501(c)(3) nonprofit, operating 13 clinic locations, 10 school sites and a mobile unit. It provides medical, dental, pharmacy and behavioral health care services to primarily low-income, medically underserved populations as well as the migrant and seasonal farmworker population. 

The company denies any accusations of wrongdoing but has agreed to the settlement to resolve the claims.

Settlement class members can receive a number of benefits from the settlement. A claim form must be filed requesting each of the benefits. 

All class members will receive the opportunity to claim two years of three-bureau credit monitoring and $1 million in identity theft insurance services. 

They can also claim cash payments of up to $7,500 per class member for reimbursement of certain documented losses, such as credit card or debit card cancellation or replacement fees, late fees, declined payment fees, overdraft fees, returned check fees, customer service fees, credit-related costs associated with purchasing credit reports, credit monitoring or identity theft protection, costs to place a freeze or alert on credit reports, costs to replace a driver’s license, state identification card, Social Security number, professional services, and out-of-pocket expenses for notary, fax, postage, delivery, copying, mileage, and long-distance telephone charges.

If the total of these claims exceeds $1 million, each claim will be proportionately reduced. 

Class members may also claim reimbursement for up to four hours of lost time at a rate of $20 an hour. 

The deadline to opt out of or object to the settlement is Nov. 12, 2023.

A final fairness hearing in the Salud Family Health data breach class action lawsuit settlement will take place on Dec. 13, 2023.

Claim forms must be submitted by Dec. 12, 2023.
