Reiter Affiliated Cos. has reached a nationwide class action settlement with a California subclass related to a data breach of its employer welfare and pension plans.
The class includes those who received written notice that their personally identifying information may have been compromised as a result of the data breach discovered on or around July 4, 2022.Â
There is a California subclass of anyone who received written notice that their personally identifying information may have been compromised as a result of the data breach and who was living in California as of July 4, 2022.
Reiter Affiliated is accused of failing to implement reasonable security measures to protect the personal information of employees related to the data breach. The company is also accused of failing to promptly inform those affected by the data breach.
Reiter Affiliated Cos. is the largest fresh berry producer in the world, growing Driscoll’s varieties of strawberries, raspberries, blueberries and blackberries year-round in the United States, Baja California, Central Mexico, Portugal, Morocco, Canada, Germany, Peru and China. The California-based company began selling strawberries under Driscoll’s after World War II.
Under the terms of the settlement, class members can receive up to $4,000 to reimburse documented out-of-pocket expenses related to the data incident. These expenses must be unreimbursed expenses more likely than not caused by the data breach; must have occurred on or after July 4, 2022, and before Nov. 24, 2023. The class member must have made reasonable efforts to avoid or seek reimbursement for these expenses.
Those who are not California subclass members and submit a valid claim showing they spent at least one full hour on activities dealing with the data breach will receive $20 per hour for up to three hours, or $60 total.
The California subclass is set to receive a payment up to $75 apiece, with a $196,050 cap on overall payments. If the amount claimed exceeds that number, class members each will receive an equal share of the $196,050.
All class members are eligible for 24 months of three-bureau credit monitoring with $1 million reimbursement insurance and identity-restoration services from Equifax, TransUnion or a similar provider.
The exclusion and objection deadline has passed.
A final fairness hearing in the settlement will take place Jan. 19, 2024.
The claim form deadline is Nov. 24, 2023.
