Update:
A settlement has been reached in a class action lawsuit against Community Surgical Supply that claimed the company failed to protect its customers’ personally identifiable information (PII) during a data breach in which an unauthorized third party gained access to the company’s systems.
The settlement class is made up of anyone whose full name and other PII was potentially accessed during the data incident between Oct. 15, 2021, and Dec. 20, 2021.
By allowing the security breach, the plaintiff asserted, Community Surgical Supply was guilty of negligence, negligence per se, breach of confidence, intrusion upon seclusion, breach of implied contract, unjust enrichment and violation of the New Jersey Consumer Fraud Act.
The private information that was allegedly compromised included full names, Social Security numbers, driver’s license numbers or other government identification numbers and passport numbers.
Community Surgical Supply is a clinically focused home care equipment and services provider with 18 locations in the northeast United States.
The company denies any accusations of wrongdoing but has agreed to the settlement to resolve the claims.
Settlement class members can receive a number of benefits from the settlement.
All class members will receive the opportunity to claim two years of credit monitoring services through Aura from the effective date of the settlement. A claim form must be filed requesting this service.
They can also claim cash reimbursements up to $500 for documented ordinary expenses incurred as a result of the data incident, including reimbursement for time lost dealing with the breach at a rate of $20 an hour for a maximum of three hours. Ordinary expenses include unreimbursed bank fees, long-distance phone charges, postage and more.
Class members may also claim reimbursement for extraordinary expenses related to the data breach, such as identity theft; tax, medical or other fraud; and other actual misues of their personal information, provided the loss is an actual documented and unreimbursed monetary loss that was more likely than not caused by the breach and is not already covered by one or more of the ordinary loss compensation categories. The claimant also must have made reasonable efforts to avoid or seek reimbursement for the loss, including, exhausting available credit monitoring or identity monitoring insurance. The loss must have occurred between Oct. 15, 2021, and Nov. 17, 2023.
The deadline to opt out of or object to the settlement is Nov. 2, 2023.
A final fairness hearing in the Community Surgical Supply data breach class action lawsuit settlement will take place on Nov. 9, 2023.
Claim forms must be submitted by Nov. 17, 2023.

Anyone whose full name and other PII was potentially accessed during the data incident between Oct. 15, 2021, and Dec. 20, 2021.

Reasonable documentation showing that the ordinary or extraordinary expenses were more likely than not caused by the data breach. Class members seeking reimbursement of $750 or more must provide their name, gender, date of birth and the last five digits of their Social Security number or their full Medicare Beneficiary Identification Number to be eligible to receive a payment.
