The National Association of Boards of Pharmacy (NABP) agreed to a $845,800 class action lawsuit settlement to resolve claims that it incorrectly “failed” NAPLEX test takers despite them passing the exams.
The settlement benefits a 2021 class of candidates who took the NAPLEX test administered by the National Association of Boards of Pharmacy between Aug. 31 and Sept. 8, 2021, who received a Sept. 17, 2021, notice that their NAPLEX score was incorrectly reported as “failed” when they had actually passed the test.
The settlement also benefits a 2022 class of candidates who took the NAPLEX test administered by the NABP between July 30 and Oct. 26, 2022, who received a Nov. 8, 2021, notice that their NAPLEX score was incorrectly reported.
Plaintiffs in the class action lawsuit claim that NABP negligently misscored hundreds of NAPLEX tests, resulting in candidates receiving a false “fail” result. This allegedly happened once in 2021 and then again only a year later.
The National Association of Boards of Pharmacy is a nonprofit that helps access pharmacist competency, facilitate licensure transfers and verifications and other professional services.
NABP hasn’t admitted any wrongdoing but agreed to pay $845,800 to resolve the NAPLEX test class action lawsuit.
Under the terms of the class action lawsuit settlement, class members can receive between $100 and $7,500 based on when and where they took the NAPLEX exam and if they passed subsequent NAPLEX tests or other licensure tests, such as the Multistate Pharmacy Jurisprudence Examination (MPJE).
Claimants who took the NAPLEX between Aug. 31 and Sept. 8, 2021, and later received a Sept. 17, 2021, notice that their score was incorrectly reported can receive up to $500 if they passed the MPJE or other tests before Sept. 17, 2021. Claimants who took the NAPLEX and received a notice in a similar timeframe can receive $100 if they did not pass another licensure test.
Class members who took the NAPLEX between July 30 and Oct. 26, 2022, and received a Nov. 8, 2022, notice that their score was incorrectly reported can receive $7,500 if they passed a subsequent NAPLEX, $4,000 if they passed a later MPJE or other exam or $1,000 if they did not pass another licensure test.
The deadline for exclusion and objection is Dec. 13, 2023.
The final approval hearing for the NABP class action lawsuit settlement is scheduled for Feb. 14, 2024.
In order to receive a settlement payment, class members must submit a valid claim form by Jan. 12, 2024.

2022 class: candidates who took the NAPLEX test administered by the NABP between July 30 and Oct. 26, 2022, who received a Nov. 8, 2021, notice that their NAPLEX score was incorrectly reported.
