TenantReports.com agreed to a $877,800 settlement to resolve a class action lawsuit claiming that it prepared consumer background reports that included outdated criminal non-conviction information.Â
The settlement benefits individuals who were the subject of a background report prepared by TenantReports.com between April 8, 2020, and April 9, 2023, that included information on at least one criminal non-conviction that predated the report by at least seven years.
Plaintiffs in the class action lawsuit claim that TenantReports.com violated the Fair Credit Reporting Act (FCRA) by including outdated criminal non-conviction information on consumer reports requested by landlords. Under the FCRA, consumer reports can only include non-convictions for seven years.
TenantReports.com is a screening company for landlords and property managers that allows them to run background checks on prospective tenants.Â
TenantReports.com hasn’t admitted any wrongdoing but agreed to a $877,800 settlement to resolve the background reports class action lawsuit.
Under the terms of the settlement, class members can receive an equal share of the net settlement fund. Class counsel anticipates that each claimant will receive around $75. However, actual payments may be higher or lower depending on the number of participating class members.
TenantReports.com also agreed to make changes to its business practices in order to comply with FCRA and other regulations — though it does not admit to violating these laws in the first place.
The deadline for exclusion and objection is Feb. 12, 2024.
The final approval hearing for the settlement is scheduled for Feb. 27, 2024.
In order to receive a settlement payment, class members must submit a valid claim form by Dec. 5, 2023.
