As part of a settlement to resolve a class action lawsuit, Mason Tenders has agreed to issue reimbursements to individuals whose personal identifying information and protected health information were potentially exposed in a Mason Tenders District Council data breach.
Settlement class members are those who have received a notification letter from Mason Tenders stating their personal identifying information and/or personal health information was or may have been compromised in the data incident, which, according to the lawsuit, occurred on or about Dec. 2, 2021, through on or about April 18, 2022. The lawsuit claims as many as 20,000 people were affected.
The class action lawsuit claimed Mason Tenders’ District Council failed to implement and maintain reasonable security measures, but the organization denies allegations of wrongdoing.
The lawsuit claimed hackers had “unfettered access” to Mason Tenders’ computer system for nearly five months. The lawsuit claims Mason Tenders failed to monitor their computer systems and didn’t discover the breach for months after the incident initially occurred. The susceptible information allegedly included dates of birth, Social Security numbers and health insurance information.
The Mason Tenders’ District Council is a labor organization based in New York, serving more than 17,000 members, including construction workers, asbestos and hazardous materials handlers, Catholic high school teachers, and recycling and waste handlers, according to the council’s website.
Under the terms of the settlement, class members will be reimbursed $20 per hour for up to three hours of time spent in response to the data breach. The settlement also allows for reimbursement of out-of-pocket expenses and losses of up to $450 incurred as a result of identity theft or similar criminal misuse of their information.
The settlement will also reimburse class members up to $2,500 for “extraordinary out-of-pocket expenses of losses as a result of identity theft” resulting from the data breach. Class members are also eligible to receive one year of identity theft protection and credit monitoring.
Class members may exclude themselves from the settlement or object to the settlement in writing by Sept. 5, 2023.
The final hearing will be held Oct. 11, 2023.
The claim form deadline is Oct. 3, 2023.

Receipt or other proof of purchase for each credit report or product purchased, documentation demonstrating the class member made reasonable efforts to avoid, or seek reimbursement for, the loss, including but not limited to exhaustion of benefits made available any credit card, credit monitoring, identity protection or financial service for class members seeking reimbursement for credit reports, credit monitoring or other identity-theft insurance product purchased between Dec. 2, 2021, and Oct. 3, 2023 ; those seeking reimbursement of fees, expenses or charges should provide a copy of a statement from the company that charged them or a receipt for the amount incurred.
