Herff Jones will pay $4.35 million as part of a settlement to resolve class action lawsuit claims it failed to protect customers during a 2021 data breach when the company’s site was hacked, leading those customers to experience fraudulent charges and other losses.

The settlement benefits individuals whose payment card information was exposed during the Herff Jones data breach. Included consumers may have been notified of the breach by Herff Jones between May 12 and June 18, 2021.

Herff Jones specializes in graduation products such as class rings, caps and gowns, yearbooks, and more. 

According to a data breach class action lawsuit, graduates started to report fraudulent charges on their payment cards in May 2021. 

One plaintiff claims his card was used for nearly $400 worth of fraudulent charges. Another plaintiff says his card was charged over $250 by unauthorized users.

Shortly afterward, Herff Jones confirmed its website was hacked — putting thousands of customers at risk for credit card fraud.

“Not only did hackers skim Herff Jones’ customers’ [personally identifiable information], on information and belief, the stolen names and payment card information are now for sale on the dark web,” the Herff Jones class action lawsuit contends.

“Herff Jones’ customers face a lifetime risk of identity theft.”

According to the Herff Jones class action lawsuit, the company failed to take reasonable steps to protect customer information. Without the company’s “careless acts and omissions and the failure to protect customers’ data,” the data breach would never have occurred, the plaintiffs argue.

Herff Jones hasn’t admitted to any wrongdoing. However, the company agreed to pay $4.35 million to resolve the class action lawsuit.

Under the terms of the settlement, Class Members can receive a cash payment. Payments will vary depending on individual situations.

Class Members who can attest to using a payment card on the Herff Jones website during the data breach period can collect a flat payment of $75. 

Additional compensation is available for Class Members who experienced fraudulent charges as a result of the data breach. 

Reimbursement includes up to $5,000 for out-of-pocket expenses and up to $200 for lost time at a rate of $25 per hour.

The deadline for exclusion and objection is April 12, 2022. 

The final approval hearing for the Herff Jones data breach settlement is scheduled for July 18, 2022.

In order to benefit from the settlement, Class Members must submit a valid claim form by May 12, 2022.

    I should have received atleast 175$ but legally 400 because I had proof of everything. And 100$ for people living in California. What is going on. Was this a scam. I’m so stressed out now.

          I am having issue also and now I cant access the links to this lawsuit because it shows an error. I am extremely concerned about this being a scam. The minimum payment should have been 75$ and an extra 100 if u lived in California
          What is actually going on. Where did all this money go.

        I also received a virtual card, but it won’t add to my wallet. It says “Could not add card”. Wondering if that email was a scam. This is crazy! They should’ve just mailed cards instead of trying to send them digitally if it’s not a scam.

        Yes, I am. I am concerned about this being a scam. Because people in California should have gotten a minimum of 100$ and now I cant access any of the claim websites they all show error code now.

      I got 129$ and I should have recieved atleast 400 because I lost wages, I live in California, and they stole almost 1500$ out of my bank. What the H$%^

      I received a check today for $32.45. Had over $2000 removed from account although after many trips to the bank and paperwork it was returned to me but it caused a lot stress and anxiety. This check was a slap in the face

    I successfully submitted a claim, but have yet to hear back from anyone. The last I heard was that this would be decided upon by the courts back on July 18th. However, we are now in August and I still have heard nothing.

      I agree, I’m currently waiting for a response as well. I know there’s a lot going on behind the scene but it would be nice to at least hear from someone. I lost more than 5,000 dollars as a result of this breech.
