Rady Children’s Hospital-San Diego has agreed to a class action lawsuit settlement to resolve claims it failed to prevent a 2020 data breach.

The settlement benefits patients (or their guardians) who were admitted as radiology patients or received radiology treatment at Rady Children’s Hospital-San Diego or its related locations before Jan. 3, 2020, and who received a data breach notice dated Feb. 21, 2020.

Rady Children’s Hospital is a large healthcare center in San Diego and the only center in the area that provides exclusively pediatric care. According to the hospital’s website, it is the largest hospital in California and serves 91 percent of the region’s children.

From June 2019 to January 2020, the prominent healthcare center was subject to a data breach. During the breach, unauthorized parties gained access to records of 2,360 patients. The hackers reportedly accessed information such as names, genders, birth dates, guardian information, and sensitive healthcare data.

The breach was discovered Jan. 3, 2020. According to the settlement website, patients received a notice of this data breach Feb. 21, 2020.

Although the hospital resolved the breach, some affected individuals took legal action. According to the data breach class action lawsuit, Rady Children’s Hospital failed to protect patient information, detect and resolve the breach in a timely fashion, and inform affected patients quickly enough.

Rady Children’s Hospital-San Diego hasn’t admitted any wrongdoing but agreed to settle these claims with a class action settlement.

An undisclosed settlement amount will be used to fund cash payments for Class Members. Benefits will vary depending on which Subclass a patient falls into. These Subclasses are based on the servers a patient’s information was stored on. 

Subclass 1 will receive cash payments of $125 and up to $400 in out-of-pocket expenses. 

Subclass 2 will receive cash payments of $35 and up to $400 for out-of-pocket expenses. 

Reimbursed expenses could include lost time, cellphone charges, internet usage, fraud charges, identity monitoring services, and more.

In addition to these cash payments, the settlement also provides one year of Experian Identity Works — a credit and identity monitoring service.

The deadline for exclusion requests and objections in the settlement is Feb. 14, 2022.

The final approval hearing is scheduled for May 6, 2022.

In order to benefit from the settlement, Class Members must submit a valid claim form by March 30, 2022.
