Cash Express has agreed to establish an $850,000 settlement fund resolving a data breach class action lawsuit filed over concerns surrounding a cyberattack on the company’s network.
The settlement class is made up of those who reside in the United States and whose private information may have been compromised in connection with a cyberattack between Jan. 29 and Feb. 6, 2022. Individuals were notified via mail if they were members of the settlement class.
The data breach class action lawsuit against Cash Express alleged claims of breach of implied contract, unjust enrichment and violations of the Tennessee Identity Theft Deterrence Act. The lawsuit alleges class members’ names, dates of birth, Social Security numbers, limited medical details and bank routing numbers, bank account numbers and driver’s license numbers were exposed.
The lawsuit claims Cash Express was negligent and did not do enough to safeguard its borrowers’ data. Cash Express denies any wrongdoing and asserts it reached the settlement to avoid the risk associated with a trial.
Cash Express, headquartered in Cookeville, Tennessee, is a lending institution that offers flex loans, payday loans, installment loans, title loans, pawn loans and other services. It has locations in Tennessee, Mississippi, Alabama and Kentucky. The breach compromised approximately 106,000 individuals’ data.
Under the terms of the Cash Express data breach settlement, class members could receive a pro rata payment cash of approximately $150; this amount could be adjusted depending on several factors, including attorney and administrative fees and how many claims are filed.
The fund will provide up to $5,000 per person in the settlement class who, with supporting documentation, can show out-of-pocket monetary losses reasonably traceable to the cyberattack, including up to five hours of lost time at $25 per hour.
Class members may exclude themselves from the Cash Express data breach settlement or object to it by Oct. 2, 2023.
The final approval hearing will be held Nov. 9, 2023.
The claim form deadline is Nov. 1, 2023.
