Parties have reached a settlement in a Harbor Freight Tools deceptive pricing class action lawsuit.
Customers who between April 8, 2011 and Dec. 15, 2016 purchased merchandise from Harbor Freight Tools that was advertised with a higher reference price, or “comp price,” next to the actual offering price may be eligible for a settlement payment.
Plaintiff Jeffrey Beck accused defendant Harbor Freight Tools USA Inc. of deceptively promoting its merchandise as being “on sale” or marked with allegedly fictional “comp at” prices used to create the illusion of a discount.
According to Beck, items marked with a “comp at” price were not actually offered for sale at that price for 28 of the preceding 90 days. Beck claimed that Harbor Freight Tools never sells this merchandise at the stated “comp at” prices.
Therefore the difference between the “comp at” price and the actual offering price was a fictional discount designed to deceive consumers, Beck claimed. He argued that this Harbor Freight Tools deceptive pricing violated consumer protection laws.
The settlement does not require Harbor Freight to admit any liability or legal fault, and the court has made no such determination. Harbor Freight maintains it has complied with all applicable laws.
Who’s Eligible
Class Members covered by the settlement include U.S. customers who between April 8, 2011 and Dec. 15, 2016 purchased any product from Harbor Freight Tools that was advertised with a higher reference price adjacent to a lower current offering price, but which was not sold by Harbor Freight Tools at the higher reference price for at least 28 of the last 90 days prior to purchase.

Qualifying Class Members have three possible recovery options, depending on how they can document their qualifying purchases:
- A refund of either 20 percent in cash or 30 percent on a Harbor Freight Tools gift card of the “you saved” amount shown on a Harbor Freight Tools purchase receipt
- A refund of either 10 percent in cash or 12 percent on a Harbor Freight Tools gift card of the total amount of qualifying Harbor Freight Tools purchases shown on a credit or debit card statement
- A $10 Harbor Freight Tools gift card
Proof of Purchase
Class Members must submit one or more of the following to document their qualifying purchases:
- An itemized Harbor Freight Tools receipt from purchases between April 8, 2011 and Dec. 15, 2016 that show a “you saved” amount
- Copies of a credit or debit card statement showing Harbor Freight Tools purchases from between April 8, 2011 and Dec. 15, 2016
- A declaration signed under penalty of perjury stating that they purchased Harbor Freight Tools merchandise that was advertised with a higher reference price next to a lower offering price, and that they do not have a receipt or card statement documenting that purchase

UPDATE: The Harbor Freight Tools Deceptive Pricing Class Action Settlement was granted final approval on November 3, 2017. However, on November 17, 2017, a notice of appeal was filed. I submitted receipts which had been emailed to me from Harbor Freight as I used that option in the store versus a paper receipt, but I never received anything from the settlement. Quite honestly, I had forgotten about it until now when I was cleaning out my inbox where I had the original settlement email stored. I recall sending in my form and attaching those receipts to the email.
I never received my settlement. I moved twice since I submitted my claim with receipts but never had any correspondence since submitting everything ON TIME! Any help is appreciated.
I beleive mine went to my old address how can i find out if it was cashed
I reached out to them multiple times yesterday regarding my A and B claims and FINALLY received some concrete explanation.
******CALCULATIONS******
Group A cash: Raised from 20% to 54%
Group A credit: Raised from 30% to 60%
Group B cash: Raised from 10% to 18%
Group B credit: Raised from 12% to 18% credit
Group C: All remaining funds after the A and B claims were divided equally resulting in the $160.
In addition, they did provide the dollar amount I was receiving with a breakdown. Though it seems lower than it should be, I will be going back to my receipts to ensure they got the total “You Saved” amount correct. I am STILL waiting on the gift cards and too was told, “all compensation should be mailed out by 12/7”.

I’m still waiting too. I called the settlement hotline and talked to a rep who said they are sending out gift cards and checks to people who submitted itemized receipts ‘as they get to them’. Its been 6 months since they sent out the non-itemized claims so he said that it will take longer for them to go through all of the itemized claims. This website said they would have to pay within 3 months, but the settlement GCG website would give no deadline.
I was told something was sent to my husband but he never received a thing.
Any updates Option A and Option B?
I was told that it is settled now and should be getting gift cards in 4-6 weeks.
Is anyone else in Class C still waiting for their gift card? I haven’t received one and I’m a class c claimant. I can’t reach the administrator by phone, so I wrote a letter weeks ago, but still haven’t got a response. What’s going on?

TCA website & the claim form showed 3 options to file a claim. Those filers are being referred to as class A, B & C claimants
I am Class A / B and haven’t received anything yet. I read all Class’s should have been mailed byJune 26th. Still wondering what’s going on myself.
Gift Cards for the Option A and Option B, all are now on hold with no date given.
Based on being given a mailing date of no later than 6/26. On Friday 6/29, I reached out to the Class Administrators and then the Class Counsel for answers. Here are the answers I received.
Here is what I received from Class Administrators:
“There has not currently been a date set for when the Option A & B gift cards will be mailed. We are still awaiting approval from Class Counsel to mail the gift cards.”
So, being told they are waiting on approval. I sent the Class Counsel an email.
Here is what I received from Class Counsel:
“There are some issues with the administrator that we are working through at the moment, so distribution is temporarily on hold. We are continuing to work hard for you and the other class members so that payments can issue as soon as possible. Thank you for your patience.”
So, it does not look like we will be getting the gift cards anytime soon.
David Batten, Thank you for that update. Did class counsel address what the issue is the Class C distribution being incomplete? Not all Class C claimants
received the gift card supposedly mail on April 30, 2018. Is that category also part of the “hold up”?? Looks like they started, then stopped & the amount was a significantly higher payout on the gift card than was originally advertised. I wonder how that will affect the remainder of funds for A&B payouts. I wish they would at least update their webpage with current information on claim status.
Brown, The only info I have is what I posted. No idea what the delay is or any issues with class “C” payouts.
If it is with Harbor Freight, I just looked at the original court cases. No activity with them or any new court cases involving HF.
