Evernorth Health Inc. and MDLive Inc. agreed to pay up to $3.5 million to resolve a class action lawsuit claiming they shared the sensitive information of MDLive website users nationwide with Google and Meta without consent.

The MDLive settlement benefits all MDLive users who accessed MDLive’s portal, patient.mdlive.com, and engaged in any activity on the portal after signing in from May 30, 2023, through Aug. 11, 2025.

According to plaintiffs in the class action lawsuit, Evernorth Health and MDLive disclosed website users’ sensitive information and private communications to Google and Meta without consent, in violation of the Florida Security of Communications Act and the federal Electronic Communications Privacy Act.

MDLIVE is a telehealth platform owned by Evernorth Health. The companies have not admitted any wrongdoing but agreed to the class action settlement to resolve the data privacy lawsuit.

Under the terms of the MDLive settlement, class members can receive a cash payment of up to $15. These payments will be reduced on a pro rata basis if approved claims exceed the net settlement fund.

To be eligible for a payment, class members must attest that they had an active Facebook and/or Google account between May 30, 2023, and Aug. 11, 2025.

Payments will be issued by check unless class members elect to receive payment via PayPal or Venmo. Checks will expire 90 days after they are issued.

The deadline for exclusion and objection is Nov. 16, 2026.

The final approval hearing for the MDLive settlement is scheduled for Jan. 6, 2027.

To receive settlement benefits, class members must submit their claim by Dec. 1, 2026.
