Tacoma Dodge Chrysler Jeep Ram, otherwise known as the Universal Auto Group, has agreed to settle a TCPA class action lawsuit over allegations that the car dealership placed robocalls to potential customers.

Lead plaintiff Robert Lee Taylor, Sr. filed the Dodge Chrysler Jeep Ram class action lawsuit after claiming to have received multiple unsolicited phone calls over the course of two years.

According to Taylor, he purchased a vehicle from another dealership owned by Tacoma Auto Mall who then allegedly sold their clientele list to the new owners of Tacoma Dodge when they went out out business.

The Dodge TCPA class action lawsuit claims that Taylor first received a “welcome” robocall which invited customers of the previous dealership to “drop on in, say ‘Hi,’ or grab a cup of coffee.” Taylor alleges that this pre-recorded message was sent as a way to obtain new business.

Between May 2011 and October 2013, the Dodge Chrysler class action lawsuit states that Taylor received additional unwanted cell phone calls reminding him of the recommended maintenance for his vehicle, informing him that he missed his maintenance, and telling him that he missed many of his recommended maintenance services.

Taylor says he did not provide prior express consent for Tacoma Dodge Chrysler Jeep Ram to send him solicitation phone calls. The TCPA class action lawsuit claims that the numerous robocalls were in violation of Washington state and federal laws.

The Telephone Consumer Protection Act prohibits text message spam, robocalls, unwanted cell phone calls and various other methods that are often used by telemarketers.

Tacoma Dodge denies allegations of violating state and federal laws but agreed to the TCPA class action settlement in order to avoid the cost of further litigation.

UPDATE: The Tacoma Dodge settlement was granted final approval on Feb. 3, 2016. 

Who’s Eligible

Tacoma Dodge Chrysler Jeep Ram class action settlement Class Members include all individuals who owned one of the 8,143 telephone numbers that Tacoma Dodge’s vendor claims it called on behalf of Tacoma Dodge.

Potential Award

$35 or $60.

The Tacoma Dodge class action settlement will provide $60 oil change certificates or $35 in cash to Class Members who file a valid Claim Form.

Proof of Purchase

N/A.

Class Members do not have to provide proof of purchase but they must submit a valid Claim Form.
