Visa and Mastercard agreed to pay a combined $167.5 million class action settlement to resolve claims that they violated federal and state antitrust laws by prohibiting independent ATM operators from charging differential ATM surcharges.
The non-bank ATM settlement benefits individuals who were charged an access fee for a cash withdrawal at an independent ATM between Oct. 24, 2007, and Aug. 14, 2026, and were not fully reimbursed by their bank. Individuals from California, Illinois, Massachusetts and Michigan are included as separate state-wide classes.
According to the class action lawsuit, Visa and Mastercard violated federal and state antitrust laws by prohibiting independent ATM operators from charging different access fees based on the network used to process the transaction. As a result, consumers were allegedly forced to pay higher access fees than they should have.
Visa and Mastercard are payment networks that allow consumers to use debit and credit cards to pay for goods and services. These networks also allow consumers to withdraw cash from ATMs.
Visa and Mastercard have not admitted any wrongdoing but agreed to a $167.5 million class action settlement to resolve the allegations. Visa agreed to pay $88,775,000, and Mastercard agreed to pay $78,725,000.
Under the terms of the non-bank ATM settlement, class members can receive a proportional share of the net settlement fund based on the number of qualifying surcharged transactions they submit.
Exact payment amounts will vary depending on the number of claims filed with the settlement. No payment estimates are available at this time.
The deadline for exclusion and objection is Dec. 11, 2026.
The final approval hearing for the ATM fees settlement is scheduled for Feb. 17, 2027.
To receive settlement benefits, class members must submit a valid claim form by Feb. 10, 2027.
