CSX agreed to pay $1.75 million in a Curtis Bay settlement resolving claims a 2021 explosion at its Baltimore facility covered the surrounding homes in coal dust.

The settlement benefits individuals who owned residential property on or since Dec. 30, 2021, or who resided in a residential property on Dec. 30, 2021, that was within the Curtis Bay class area, defined in the “Who’s Eligible” section below.

On Dec. 30, 2021, an explosion reportedly occurred at the CSX Transfer Facility in Baltimore. According to a subsequent class action lawsuit, the explosion was a result of CSX’s negligence and covered the surrounding neighborhoods in coal dust.

CSX Transportation is a railroad supplier with a network that serves around 20,000 miles of track in 26 states.

CSX Transportation hasn’t admitted any wrongdoing but agreed to a $1.75 million settlement to resolve the explosion class action lawsuit.

Under the terms of the Curtis Bay settlement, class members can receive a cash payment. Payment amounts will vary depending on the number of claims filed with the settlement. No payment estimates are available at this time.

The deadline for exclusion and objection is July 18, 2024.

The final approval hearing for the settlement is scheduled for Sept. 11, 2024.

To receive the Curtis Bay settlement benefits, class members must submit a valid claim form by July 18, 2024.


Who’s Eligible

Individuals who owned residential property on or since Dec. 30, 2021, or who resided in a residential property on Dec. 30, 2021, that was within the Curtis Bay class area

Curtis Bay class area: Beginning at the intersection of West Bay Avenue and East Patapsco Avenue, extending southeast to the intersection of East Patapsco Avenue and Curtis Avenue, then extending south along Curtis Avenue until its intersection with railroad tracks (located at approximately 39.216431, -71.586-087), then southwest to the intersection of Branch Avenue and Arundel Boulevard, then northwest to the intersection of West Bay Avenue and Church Street. then north along West Bay Avenue to the intersection of West Bay Avenue and East Patapsco Avenue. Consumers can find a full list of eligible addresses on the settlement website.
