Hard Rock vouchers class action lawsuit overview: 

  • Who: Vincent DiBenedetto filed a class action lawsuit against Hard Rock Cafe International (USA) Inc. 
  • Why: DiBenedetto claims Hard Rock makes it difficult for casino players to get change when cashing out their gaming vouchers.
  • Where: The class action lawsuit was filed in New York federal court.

Hard Rock Cafe fails to provide change to casino players using ticket redemption kiosks to cash out their gaming vouchers, a new class action lawsuit alleges. 

Plaintiff Vincent DiBenedetto claims Hard Rock’s ticket redemption kiosks fail to dispense coins to casino players, rather paying out only whole dollar amounts. 

DiBenedetto argues further that Hard Rock’s ticket redemption kiosks do not “provide any meaningful instruction on how to redeem the balance.” 

“No signage is available anywhere in the casino informing players on where to cash the remaining balance,” the Hard Rock class action states. 

DiBenedetto claims that, instead of paying out coins, Hard Rock’s ticket redemption kiosks print additional “cash out” voucher tickets for the amount of change still owed. 

Instead of going to cash out their change vouchers, players may decide just to discard them or “even toss them into a fountain,” according to the Hard Rock class action. 

Many casino players ‘unsure’ of how to redeem change vouchers, says class action

“Many players are unsure of where to redeem their vouchers, and the ones who are decide it is inconvenient to wait in a line for over forty minutes to obtain the change they are entitled to,” states the Hard Rock class action. 

DiBenedetto wants to represent a New York class and multi-state consumer fraud class of individuals who have placed a wager at a Hard Rock casino. 

Hard Rock is accused of unjust enrichment, breach of contract and conversion, and of violating various state consumer fraud acts, New York General Business Law, the Florida Deceptive and Unfair Trade Practices Act, and the New Jersey Consumer Fraud Act

Plaintiff is demanding a jury trial and requesting declaratory relief along with an award of monetary, statutory and/or punitive damages for himself and all class members. 

A similar class action lawsuit was filed against Caesars Entertainment in September by a consumer claiming the company fails to provide change to casino players who cash out their slot machine gaming vouchers.

    Here in California, San Manuel casino, morongo casino, pechanga casino, pala casino, Barona casino, pauma casino, Saboba casino, viejas casino Chumash casino, and valley view casino have all failed to return change when cashing out cash vouchers.
