Midwest Bank unlawfully charges customers multiple insufficient funds fees and overdraft fees for a single transaction, according to a class action lawsuit filed April 21 in Nebraska federal court.

Plaintiff Ezekiel D. Potter says he attempted to pay $1,050 by check in November 2022. Midwest Bank allegedly rejected the payment and charged Potter a $31 fee.

About a week later, Midwest Bank allegedly processed the check a second time, rejected it, and charged Potter another $31 fee. As a result, Potter paid a total of $62 in fees for the rejected check, the Midwest Bank class action lawsuit says.

“The improper fees charged by [Midwest Bank] were not errors, but rather intentional charges made by defendant as part of its standard processing of items,” the Midwest Bank class action lawsuit says.

Potter points to the fee schedule in his contract, which indicates a Midwest Bank overdraft fee of $28 will be charged for each overdraft created by check, in-person withdrawal or other electronic means.

“The same ‘item’ on an account cannot conceivably be rejected for payment then reprocessed,” the Midwest Bank class action lawsuit states. Further, the fee schedule does not indicate a single item may incur multiple fees, Potter notes.

Potter seeks to represent himself and a proposed class of other Midwest Bank checking account holders who were assessed multiple overdraft fees on an item during the applicable statute of limitations.

The class action lawsuit asserts claims for breach of contract, breach of the covenant of good faith and fair dealing and unjust enrichment.

Last summer, Bank of America agreed to an $8 million overdraft fee settlement to resolve allegations it charged customers multiple fees on the same transaction in violation of their account agreements. That settlement is now open.
